Record of the last will and testament of Daniel Varney deceased together with the proofs touching the geninities and validity of the same.
The last Will and Testament of Daniel Varney
I Daniel Varney of the town of Luzerne in the county of Warren and state of New York being of sound mind and memory & being desirous of making such distribution of my estate as shall be just and equitable do make publish and declare this my last will & testiment in form & manner following. That is to say -
First - I give and bequeath to my beloved wife Anna all my estate both real & personal of whatever nature or kind to have & to hold, the same with the rents & profits thereof for her support & maintenance during her natural life.
Second - I herein further direct that whatever is left & remaining of my property after the decease of my beloved wife shall be divided between & among my children as follows.
Third - I give and bequeath to my daughter Elizabeth Potter the sum of five dollars.
Fourth - The rest & residue I give & bequeath to my seven children herein after named viz David Varney, Abner Varney, Daniel Varney Jr., Josiah S. Varney, Mary Jane Hartman, Esther Newton & Alvira Hartman - All of the seven children above named are to receive equal shares & share alike except my son Josiah in consideration of what he has hiretofore had out of my estate I direct that his share shall be one hundred dollars less than either share to the other six children.
I hereby nominate constitute and appoint my two sons viz Abner Varney & David Varney executors of this my last will and testament.
In witness whereof I have herein to set my hand and seal this twenty seventh day of sixth month one thousand eight hundred & sixty five hereby requesting Jonathan W. Potter, Joseph E. Potter and William Sweet to sign their names as witnesses to this my last will and testament & in the presence.
