THIRD FATALITY OCCURS ON EVE OF NEW YEAR
Crit Deaton, Father of Nine, Driver Freed After Inquiry

Crit Deaton, 41, of 1631 Garfield Street, father of eight children, was injuried fatally early Saturday night when struck struck by an automobile while walking across South Main Street, opposite the city refuse lot.
His death was the third traffic fatality reported in Middletown during 1938. Four died here in 1937. Albert J. Seamon, 42, of Trenton driver of the death car, told officers he did not see the victim and was not sure what he had hit until he stopped his car and walked back to the point where Deaton was lying in the roadway.
NECK IS BROKEN
Corner Harry Deubel examined Deaton's body at Middletown Hospital and said death was caused by a broken neck. The man also suffered fractures of both legs in addition to other injuries.
Deaton was accompanied by Carl Storey, Negro, of 718 Seventeenth Avenue and Napoleon Clemons, Negro, of 1702 Vermont Street. The trio had been gathering kindling wood at the dump and was enroot to their homes when the accident occurred.
Storey and Clemons told Deputy Sheriff Arthur Linkins that Deaton started back across the highway to learn the contents being dumped by a truck which pulled into the lot just after they left, and was struck by the southbound automobile.
CONSTABLE NOTIFIED

Storey notified Constable Harry Spencer of the mishap and the later placed the man in his automobile and stared to the hospital. Deaton died enroot to that institution.
Seamon was taken into custody by State Highway Patrolman Max Lambert and James Gardner at the scene of the accident and taken to the Highway Patrol station to make a statement regarding the accident.
His car was placed in a public garage and he was held in custody pending the completion of Coroner Deubel's investigation, and then released.
Sergeant Harvey Kurth of the Middletown Police Department, aided the Highway patrolmen in their investigation of the accident which was reported to the patrol and not Police Headquarters.
Deaton was a WPA worker and had been living in Middletown for 15 years, coming here from Lee County, Ky. Surviving are his widow, Ellice; four sons, Paul, Herschel, Lonnie and Ronald; four daughters, Juanita, Linnie, Inez and Ilene; a sister Ida Spencer of Rochester, Mich., and three brothers, Oscar of Rochester, and James and John of Kentucky.
The body was removed to the Wilson and Sons Funeral Home.
Arrangements are incomplete.
