WILL OF THOMAS MILLS Submitted by Diane J. Nichols. In the name of God amen I Thomas Mills of the County of Ohio and Commonwealth of Virginia being of sound and perfect memory thanks be to Almighty God, tho of an infirm and weak state of body, calling to Mind the certainty of death and uncertainty of this life, do make ordain and publish this my last will and testament, in Manner and form following to wit, ( I will and direct that my body be buried in a Christian like manner, and out of my estate, all my Just debts and funeral expenses be first paid. Item I will and direct that the Plantation on which I now live, and occupied by my own son John Mills, be sold at public auction, within six months after my decease by my Executors, upon such terms as they shall deem most advantageous, and I further will and direct that the proceeds of the sales of the said plantation be equally divided between my three sons John Edward and Thomas, and I further will and direct that my son Edward be paid his part of the said proceeds of the sale of the said plantation out of the first monies received for the same. Item, I will and bequeath my two daughters Margaret Zane and Jane Carpenter fifty pounds each, to be paid to them by my said son Edward out of his dividend of the proceeds of the sale of my plantation, and his said dividend is hereby charged and incumbered with the payment of the said two legacies to the said Margaret Zane and Jane Carpenter. Item, I will and direct that my son John receive his dividend of the sales of my said plantation out of the monies next received for the same, after the payment of my son Edwards dividend, and I will and bequeath to my daughters Mary Gilkenson and Rebeckah Williams fifty pounds each to be paid by my son John out of his dividend of the proceeds of the sale of my plantation and the said dividend of my son John is hereby charged and incumbered with the payment of the said two legacies to my said two daughters Mary Gilkerson and Rebecka Williams. Item I will and direct that my son Thomas received his dividend of the proceeds of the sales of my said plantation of the last monies received for the same, and I will and bequeath to my daughters Sarah Briceson and Hannah Zane fifty pounds each to be paid by my said son Thomas out of his dividend of the proceeds of the sale of my said plantation and the said dividend of my said son Thomas is hereby charged and incumbered with the payment of the said legacies to my two daughters Sarah Briceson and Hannah Zane. Item I will and bequeath to my grandson Thomas Howard fifty pounds to be paid by my three sons in equal portions upon the condition that the father of the said Thomas Howard will bind him to some trade, the said sum to be paid when my Grand son Thomas Howard arrives at the age of twenty one years, but if the father of my Grand son Thomas Howard will not bind him to some trade, then I will and bequeath that one half the said sum of fifty pounds be paid to my Grand Son Ezekiel Howard when he arrives at the age of twenty one years, and the legacies to my said three Sons are hereby in equal proportions charged and incumbered with the payment of the said Sum of fifty pounds to my said Grand Son Thomas Howard, or to the said Thomas and Ezekeil Howard as the case may be,) and I hereby constitute and appoint my son John Mills and Jonathan Zane the sole Executors of this my last will and testament, hereby revoking and annuling all other or former wills or testaments by me made, signed sealed and published by me as my last will and testament this twenty fifth day of (?July) in the year 1808. in the presence of Wm.
