Westmoreland County, PA, Will Book 1, Page 422-23 This the twenty-eighth day of the fourth month in the year of our Lord eighteen hundred and sixteen, I Daniel Hammond of Westmoreland County, Township of Rostraver, and Commonwealth of Pennsylvania, being far advanced in years but of sound mind & memory. Therefore, calling to mind the mortality of my body and knowing that it is appointed for all men to die, do make and ordain this my last Will & Testament. First of all I order that my body be buried in a Christian like and decent manner at the discretion of my Executors. And as touches such worldly estate, wherewith it hath pleased providence to bless me with in this life, I give, devise, and dispose of in the following manner and in form imprinus. It is my will and I do order that in the first place all my just debts and funeral charges be paid and satisfied. Item: I give and bequeath unto Samuel Hammond, son of my son James, fifty-five acres of my land. Strict measure adjoining lands of Robert Patterson, Joshua Budd, & the sawmill lot, agreeable to lines run some time back by John Shreve only as said lines run of sixty-five acres. I order that ten acres thereof be run of to my other lands with a straight line back or east of my orchard, one hundred and six perches South, forty-six and a fourth degrees East. Unto the said Samuel his heirs & assigns forever. Nevertheless it is my will and I do order that my son James & his wife Hannah shall have the use and occupancy thereof with the profits arising therefrom as long as they or either of them lives. Item: I have given heretofore unto the heirs of my son Samuel his share in full of my real estate. Item: I here certify that I have given unto my son Daniel his share in full of my real estate. Item: It is my will and I do order that the remainder of my land or plantation not heretofore Willed or otherwise disposed of be put to sale by my Executor immediately or as soon as may be after my death. Either by public or private sales to the highest and best bidder in sales or otherwise to the most advantage to my heirs and the money or amount when recovered divided in three equal shares and paid to the following persons. Viz. One-third to the children of my daughter, Mary Stench Comb, namely Daniel Camp & her daughter Catherine, George, James & John each one equal shares of said third. Viz. I also will and bequeath one-third as above stated unto my daughter, Margaret Maxwell, her son Samuel, Margaret, Mary, James, Daniel, and Elizabeth, and her said children share and share alike of said third. I also will and bequeath the remaining one-third of the amount of said land unto my daughter Priscilla Todd. Item: It is my will and I do order that all my movable estate be put to public sale as soon as convenient after my death. The amount of which when recovered with all my dues & moneys to me belonging be divided in six equal shares. Viz. Unto Samuel Hammond, son of my son James, one-sixth for the use of his fathers family, and one-sixth unto my son Daniel, one-sixth unto the children of my son Samuel, & one-sixth unto the children of my daughter Mary Stench Comb, and one-sixth unto my daughter Margaret Maxwell & her children, share and share alike, and one-sixth unto my daughter Priscilla Todd. Item: I likewise constitute, make, and ordain my only and sole Executors of this my last Will & Testament, my trusty and much respected neighbors, Archibald Stewart and John Orr. And I do hereby utterly disallow, disannul, and revoke all and every other former Wills & Testaments. In Witness whereof I have hereunto set my hand and seal the day & year

James Montgomery, Esq., registrar and for the probate of Wills in and for
said county. Comes Joseph Finley & Joseph Blackburn two of the
subscribing witnesses to the above and foregoing Will and being duly sworn,
depose and say that they saw Daniel Hammond, the above Testator who is now
deceased, sign, seal, publish, & declare the above to be his last Will
and Testament. That at the time of his so doing he was, they believe, of
sound and disposing mind and memory. That they signed the said Will as
Witnesses in his presence and that the names Joseph Finbley & Joseph
Blackburn are the proper signatures of these deponents respectively &
that the name Joseph Eckley was signed thereto as a Witness in their presence
and in the presence of the said Testator. Sworn and subscribed this tenth day
