In the matter of the Will of James Crosby, deceased.  }  September 11, 1867. This day the Last Will and Testament of James Crosby deceased late of Muskingum County, Ohio, was produced in open Court and partially proved by the oath of Henry Pletcher, whose testimony in this behalf was reduced to writing and duly filed herein.

In the matter of the Will  }  September 17, 1867. This day the Last Will and Testament of James Crosby deceased  }  of James Crosby, deceased late of Muskingum County, Ohio was produced in open court and duly proved by the oath of Washington Adamson one of the attesting and Subscribing witnesses to the last Will and Testament of James Crosby deceased late of Muskingum County , Ohio, who being duly sworn and examined in open court, declared that said testator, James Crosby, deceased, was at the time of executing and signing said last will and testament of full age Sound mind and memory and free from any restraint. That he signed the same in his presence and that he heard him acknowledge said Instrument of writing as and for his Last will and testament. That he Subscribed his name as a witness thereto in his presence. Whereupon it was ordered by the Court that said Will be and the same hereby is admitted to Probate and that the Same together with the testimony and this entry be duly recorded.

Will
"In the name of the Benevolent Father of all" I, James Crosby, of Muskingum County, Ohio, do make and publish this my last Will and Testament.

Item 1st My beloved wife, Mary Crosby, shall have and hold possession of my real estate Situated in Clay Township County and State aforesaid during her natural life unless it should be necessary for the benefit of my condition in which case I impower my wife, Mary Crosby, to sell my real estate or a part of it.

Item 2nd I will to my Son, Nelson Crosby, all the property Real and Personal that may remain after my death and the death of my wife in consideration of which he (Nelson) is to help and provide for our temporal needs as long as we or either of us may live.

Item 3rd My Son, Nelson has in possession and is to have all my personal property for the purpose of paying the claims that may be presented, legally against my estate. If said personal property is sufficient if not then to fall back upon the real estate as set fourth in item the first.

Item 4th I do hereby nominate and appoint my son Nelson Crosby execution of this my last Will and testament hereby authorizing and impowering him to compromise , adjust, release, and discharge in such manner as he may deem proper the debts and claims due me.

        On testimony whereas I have hereunto set my hand and seal this 31 day of July in the Year 1867.

Muskingum County  }
        At the Probate Court held at the office of said Court in Zanesville within and for the County aforesaid on the Eleventh day of September 1867 The Last Will and Testament of James Crosby deceased late of said County was produced in writing and Henry Pletcher one of the attesting and subscribing witnesses thereto being duly sworn and examined in open court declared that said testator, James Crosby, deceased was at the time of executing and signing said Last Will and Testament of full age, Sound mind and presence and that he heard him acknowledge said instrument of writing as and for his Last Will and Testament and that he subscribed his name as a Witness thereto in his presence.
        I Certify that the foregoing testimony was taken in open Court and reduced to writing by me and taken at he time and place specified.

        At the Probate Court held at the office of said Court in Zanesville within and for the County of Muskingum on the Seventeenth day of September 1867 The Last Will and Testament of James Crosby deceased late of Said County was produced in writing and Washington Adamson one of attesting and Subscribing witnesses thereto being duly sworn and examined in open Court declared that at the time of executing and Signing Said Last Will and testament James Crosby, deceased was of full age, Sound mind and memory and free from any restraint. That he signed the same in his presence and that he heard him acknowledge the Said instrument of writing as and for his last will and Testament and that he subscribed his name as a witness thereto in his presence.
        I Certify that the foregoing testimony was taken in open court and reduced to writing by me and taken at the time and place specified.
