Will and Testament of Nicholas Baker, dec’d Tuesday March the 2d, 1869
Be it remembered that on this day the last will and testament of Nicholas Baker late of Pike County O. was produced in open court and for proof this cause continued to the 6th March AD 1869.

This day the last will and testament of Nicholas Baker dec’d was examined in open court and proved by the oath of Wm. E. Bean one of the attesting witnesses to said will whose testimony was reduced to writing and for further proof this cause is continued to March the 9th 1869. Pike County Probate Court Tuesday March 9th 1869
Will Probated
This day the last and will and testament of Nicholas Baker dec’d being produced in open court was examined and proved by the oath of Bennett Sailor one of the attesting witnesses to said will whose testimony was reduced to writing and together with the testimony of Wm E. Bean heretofore taken and the said will of Nicholas Baker dec’d was ordered to be recorded and the said will admitted to Probate according to law.

Which will once proof are in the words and figures following to wit..
‘I, Nicholas Baker of the Township of Union County of Pike and State of Ohio being of sound and disposing mind and memory, do make and publish this my last will and testament.
Item 1st - I will and direct that all my lawful debts and funeral expenses be first paid out of my money and property.
Item 2d - After the payment of my debts and funeral expenses as aforesaid I will and direct that all the balance of my personal effects money and choses and actions Shall go to and vest in my beloved wife Margaret Baker absolutely during the term of her natural life and that the remainder go to and vest in Our children Martin Baker, Jacob Baker, Sabina Smith, Louisa Schultz and Margaret Row in fee simple share and share alike -
I do hereby revoke all former wills by me made. In testimony whereof I have here unto set my hand and seal this 4th day of October A.D 1868 Nicholus Baker (seal)
Signed and acknowledged by said Nicholus Baker as his last will and testament in our presence and signed by us in his presence at his request.

State of Ohio Pike County
On this 6th day of March A.D. 1869 personally appeared before one E. R. Allen Judge of the Probate Court within and for the Co. of Pike and State aforesaid Wm E. Bean of the Co. of Pike and State of Ohio who being duly sworn according to law deposes and says that he has now and here seen and inspected the paper writing produced as and for the last will and testament of Nicholus Baker late of said Pike County deceased, that he and Bennett Sailor are the attesting witnesses to said will that the said Nicholus Baker at the time of executing said will was of full age and sound mind and memory and was not under any restraint at the time of executing the same that said paper writing was acknowledged and declared by the said Nicholus Baker in our presence as and for his last will and testament. That the said will was read in our presence, that we attested and subscribed the same in the presence of the said Nicholus Baker at his request and that we subscribed the same in the presence of each other.

On the 9th day of March AD 1869 personally appeared before me E. R. Allen Judge of the Probate court within and for the County of Pike and State aforesaid Bennett Sailor Co. of Pike and State of Ohio who being duly sworn according to law deposeth and saith that he has now and here seen and inspected the paper writing produced as and for the last will and testament of Nicholus Baker late of said Pike Co deceased that he and one Wm. E. Bean are the attesting witnesses to said will, that the said Nicholus Baker at the time of executing said will was of full age of sound mind and memory and was not under any restraint at the time of executing the Same that said paper writing was acknowledged and declared by the said Nicholus Baker in our presence as and for his last will and testament, that the said will was read in our presence, that we attested and subscribed the same in the presence of the said Nicholus Baker at his request and that we subscribed the same in the presence of each other.
