Now comes said administrator & produces to the court the report of an assignment of Dower & appraisement herein made by S. P. Cameron, C. D. Gass, & John Allison in forswearance of a former order of this Court & it appearing to this Court upon examination hat said report is in all respects regular & correct, the same is hereby approved and confirmed & it is ordered that said administrators proceed in accordance with the law to sell the said real estate upon the premises in the petition described at not less than two thirds the appraised value upon deferred payments not less than two years.

In obedience to an order and decree of the Probate Court within and for said county, made this day in a certain cause wherein you as the Administrator of the Estate of Thomas Robinson deceased are COMPLAINANT, and heirs of said deceased et. Al. are DEFENDANTS, you are commanded that by the oaths of John Allison, C. D. Gass, and S P Cameron judicious and disinterested men of the vicinity, and upon actual view of the premises, you cause to be set off and assigned to Almira Robinson widow of the said Thomas Robinson deceased, the one full equal third part of the following premises, to wit:

The East part of the South West quarter of Section thirty three (33) in Township six (6) north of Range four East containing seventy eight (78) acres the said dower to be assigned from the south part of said premises not including any part of the following described portion of the above described premises—

Thirty two (32) acres saving and excepting therefrom a strip of land twenty (20) feet wide off from the East side of said 32 acres the said thirty two (32) acres being taken off from the north side of the premises first above described of equal width.

And said appraisers having set off and assigned said dower to the said Almira Robinson widow as aforesaid, do upon actual view make a just valuation and appraisement of said real estate, last above described the 32 acres except the (unreadable) aforesaid.

And your proceedings you will report to this Court forthwith when you have executed this order.

And now comes Almira Robinson one of said defendants & says she admits the statements & facts set forth in the said plaintiffs petition to be true & she consents & asks the Court that her said dower be assigned her from the South part of the seventy eight acres described in said petition in accordance with the request of said petition & for such other & further relief as Equity may require

Your petitioner Isaac Evans administrator of the Estate of Thomas Robinson deceased respectfully represents that the valid debts of said deceased amounting to some eight hundred dollars have already been presented to your petitioner for payment, that the costs of administration will amount to some fifty dollars & that the total value of the personal estate has already been disposed of in payment of debts not contained in above statement leaving and indebtedness of said eight hundred dollars remaining against said estate without personal property for its payment.

Your petitioner further represents that said Thomas Robinson died seised in fee simple of the following described real estate situated in the Township of Springfield in said county. The same being described as follows thirty two (32) acres saving & excepting therefrom a strip of land twenty feet (20) wide off from the East side of said thirty two (32) acres the said thirty two acres being taken from the north side of equal width from the following described premise the said deceased being seised in fee simple of the whole of the following lands at the time of his death: The East part of the South West quarter of Section thirty three (33) in Township six (6) north of Range four (4) East containing seventy eight (78) acres. The said Thomas Robinson died leaving Almira Robinson his widow who is entitle to Dower in the whole of said seventy eight acres and the following named persons his heirs at law having the nest estate of inheritance: Thomas Jefferson Robinson, Lucius Alverton Robinson, Deborah R Robinson, Sarah E Robinson, Mary a Robinson, Fremont E Robinson the above named Thomas J Robinson being now a resident of Park County Indiana.

Your petitioner therefore asks that said widow & heirs at law may be made defendants herein that they may be notified of the pendency of this action according to law and that the Dower in the whole seventy eight acres may be set off & assigned to said widow by meets & bounds from the South part thereof not interfering with the above described land asked to be sold and that your petitioner may be authorized to sell sad 32 acres saving said exception according to the Statute in such case made and provided.

In pursuance of an order of the Probate Court of Williams county Ohio, I will offer for sale at public auction, on the 4th day of June 1869, at 10 o’clock, forenoon, upon the premises the following described real estate, situated in Springfield township in said county thirty two (32) acres, excepting twenty fee wide off from the east side thereof; the said thirty two acres being taken from the north side, of equal width, from the following described land: The east part of the southwest quarter of section thirty three in township six, north of range four east, containing seventy eight acres. In foreswearance of the order of the court in this case made I gave notice of sale by publications in the Bryan Union Press a weekly newspaper of general circulation in said county of Williams for at least four successive weeks prior to the 4th day of June 1869 & on that day at 10 o’clock forenoon upon the premises in accordance with said notice I offered the real estate in the petition described for sale when C. A. Landy had to pay for the same at sum of nine hundred & seventeen dollars & thirty two cents which being the highest & best bid that was offered & more than two thirds of the appraised value of said premises I then & there struck off & sold to him.

Terms of sale one third in hand one third in one year & remainder in two years from day of sale with interest the payments secured by mortgage upon premises sold.

To Almira Robinson, widow, Thomas J. Robinson, Lucius A. Robinson, Deborah R. Robinson, Sarah E. Robinson, Mary A Robinson, Fremont E. Robinson heirs at law of Thomas Robinson deceased:

You are hereby notified that on the 7th day of April A.D. 1869 I as administrator of the estate of Thomas Robinson deceased filed a petition in the probate court of Williams County Ohio alleging that the personal estate is insufficient to pay his debts & the charges of administering his estate that he died seized in fee simple of the following described real estate situated in the township of Springfield Williams County Ohio: The east part of the south west quarter of section (?? 33 ??) in Township 6 north of range 4 east containing 78 acres & that Almira Robinson widow of said deceased is entitled to dower in said premises.

The petition asks for the assignment of dower to said Almira & for an order authorizing me to sell as administrator of said deceased to sell thirty two acres of from the north side of said premises saving 20 feet from the east end of said 32 acres for the payment of the debts and charges aforesaid.

Said petition will be for hearing on the 27th day of April A.D. 1869 at ten oclock forenoon of said day.

This day this cause came on to be heard upon the petition of said plaintiff the answer of Debts exhibits & testimony & this court hearing firstly advised in the premises does find the equity of the case with the said plaintiff & that due notice has been given to Defendants of the pendency thereof and it is ordered that John Allison, G. D. Lass and S. P. Cameron being first duly sworn as upon the (unreadable) view of the premises in the petition described, set off and assign unto Almira Robinson widow of said deceased one full equal third part of said premises the seventy eight acres described in said petition as her dower estate the same to be set off by metes & bounds from the south part of said seventy eight acres not including any part of the 32 acres in said petition described & thast they make retainer of such assignment together with a just valuation of the said 32 acres in said petition described excepting the 20 feet saving in said petition set forth (unreadable) said court with all convenient speed & intensity.

Was presented and received by me from William C. Holgate the followingclaims against the Estate of Thomas Robinson deceased, to wit:

Two notes dated "Evansport May 27th, 1861" for sum of one hundred dollars each payable to P. Evans & Lindenberger; one on or before October 1st 1864; the other on or before October 1st 1865; both drawing interest from date and secured by Mortgage executed by Thomas Robinson, and Almira Robinson May 27th 1861 on "the East fraction of the South West quarter of Section No. 33 T. 6 N, R. 4 East containing 77 69/100 acres" the same being in the county of Williams in the State of Ohio. Said Mortgage & Notes were transferred Sept 20, 1861 by Evans & Lindenberger to E. F. Lindenberger & by said E. F. Lindenberger to said William C. Holgate per endorsement on Mortgage. And said Thomas Robinson paid Holgate on the Note due October 1st 1864 the sum of $113.60 the 2nd of July 1864 per endorsement on said note.

Said notes less said endorsement at this time amounting to the sum of one hundred and fifty two dollars ninety cents ($152.90) with the interest added, is allowed by me as a valid claim against the estate of Thomas Robinson deceased. ADMINISTRATOR’S BOND

 

Know all men by hese Presents:

That we Isaac Evans, John Buck and Joseph P. Robinson of the County of Williams, and State of Ohio, are held and firmly bound unto the State of Ohio in the penal sum of two thousand dollars; for the payment whereof well and truly to be made, we jointly and severally bind ourselves, our heirs, executors, and administrators, by these presents.

Sealed with our seals this 20th day of Oct A.D. one thousand and sixty five.

The condition of the above obligation is such, that whereas Isaac Evans had by the court of Probate of Williams county aforesaid, been appointed Administrator of the Estate of Thomas Robinson late of said Williams county deceased; Now if the said Administrator shall make and return to said Court, upon oath or affirmation, within three months, a true inventory of all the Moneys, Goods, Chattels, Rights and Credits of the said deceased, which are by law to be administered, and which have or shall come to his possession or knowledge and also if required by the Court, and inventory of the real estate f said decedent; if he shall administer according to law all the moneys, goods, chattels, rights and credits, of the said decedent and the proceeds of all his real estate that may be sold for the payment of his debts, which shall at any time come to the possession of said Administrator, or to the possession of any other person for him if he shall render, upon oath, or affirmation, a true account of his administration within eighteen months from the date hereof, and at any other times when required by the Court or the Law, pay the balance remaining in his hands upon the settlement of his accounts, to such persons as the Court or the Law shall direct; and deliver the Letters of Administration into Court in case any will of the Decedent shall hereafter duly proved and allowed; then this obligation to be void and of no affect; otherwise to be and remain in full force and virtue in law.
