Springfield Volunteer Fire Department Charter (1947)

Notice of Application for Charter

Notice is hereby given that Application will be made to the Court of Common Pleas of Erie County, Pennsylvania on September 18, 1947 at 11:00 o'clock A. M. for a Charter for a non-profit Corporation.

1. The name of the proposed Corporation is - Springfield Volunteer Fire Department.

2. The said Corporation is to be organized under the provisions of the Act of May 5, 1933, P.L. 289, its supplementsand amendments.

3. The purpose of said Corporation is to support and maintain a fire engine, hook and ladder, and other fire fighting apparatus and hose company, for the control of fire and the protection of lives and property from fire in East Springfield Borough, Springfield Township and the western portion of Girard Township, Erie County, Pennsylvania.

4. Articles of Incorporation were filed in the Office of the Prothonotary of Erie County, Pennsylvania, on September 3, 1947.

In the Court of Common Pleas of Erie County, Pennsylvania No. Term, 1947.

Petition for Incorporation of Springfield Volunteer Fire Department

To the Honorable Judges of said Court:

Be it known: Thatthe subscribers, allof whom arecitizens of the Commonwealth of Pennsylvania, havingassociated themselves together for the purpose ofsupporting and maintaining a fire engine, hook and ladder, and other fire fighting apparatus and hose company, for the control of fire and the protection of lives and property from fire in East Springfield Borough, Springfield Township, and the western portion of Girard Township, Erie County, Pennsylvania, andbeing desirous ofbecoming incorporated, agreeableto the Actof Assembly ofthe Commonwealth ofPennsylvania, known as the "nonprofit CorporationLaw", approved the 5th day of May, 1933, P. L. 289, its supplements and amendements, hereby declare that the following are the purposes and conditions for and under which they desire to be incorporated.

First: The name of the proposed corporation is - Springfield Volunteer Fire Department. There is attached heretoand made a part hereof, a certificate from the Secretary of the Commonwealth of Pennsylvania, which shows that the name adopted by Petitioners for the proposed corporation has been filed of record in his office, and that said name is available for use by them.

Second:The location and post office address of the initial office of said corporations is Ridge Road, East Springfield, Pennsylvania.

Third:The said corporation is formed for the purpose of supporting and maintaining a fire engine, hook and ladder, and other fire fighting apparatus and hose company for the control of fire and protection of lives and property from fire,in East Springfield Borough, SpringfieldTownship, and the western portion ofGirard Township, ErieCounty, Pennsylvania.

Fourth: The said corporation is to exist perpetually.

Fifth: The name, place of residence, and post office address of each of the incorporaters is as follows:

Sixth: The number of Directors of said corporation is fixed at seven, and the names and addresses of those chosen to act as Directors until their successors are chosen are as follows:

Seventh: The said corporation is to be formed on a non-stock basis.

Eighth:The said corporation will have assets, consisting of cash and fire fighting apparatus, with which to start its corporate functions, is the approximate amount of thirteen thousand two hundred fifty dollars and thirty-eight cents ( $1,3250.38 ).

I do hereby certify that the name, Springfield Volunteer Fire Department being available for use by a proposed nonprofit corporation, was this day duly registered in this office in accordance with the provision of Article 11 of the Nonprofit Corporation Law ( Act No. 105 )approved the fifth day May 1933.

In testimony thereof, I have hereunto set my hand and caused the seal of the Department of State to be affixed, the day and year written above.

Order

And now, to-wit, September 25, 1947, the Articles of Incorporation of Springfield Volunteer Fire Department, a nonprofit corporation, having been presented to me, a Law Judge, of the County of Erie, Commonwealth of Pennsylvania, together with a certificate of the Department of State of said Commonwealth, that the name "Springfield Volunteer Fire Department" is available for the use of said Corporation and has been duly registered in the office of said Department, and accompanied with full proof of publication of such application as required by law, I do hereby certify that I have perused and examined the said instrument and find the same to be in proper form and within the purposes for which a nonprofit corporation may be organized, and the purposes of the proposed corporation appear to be lawful and not injurious to the community. It is therefore ordered that the Articles of Incorporation be approved and upon recording of said Articles and this Order, the subscribers thereto and their associates and successors shall be a corporation for the purposes, and upon the terms and under the name therein stated.

Petition for Leave to Amend Application of Charter

To the Honorable Judges of said Court:

Your petitioners respectfully represents:

1. That a Petition for the Incorporation of Springfield Volunteer Fire Department was duly filed in the Office of the Prothonotary of Erie County, Pennsylvania on September 3, 1947.

2. That due Notice of the presentation of said Petition to your Honorable Court has been given since the filing of said Petition.

3. That inadvertently there was not included in Paragraph 3 of said Petition the following statement: "and that it is a corporation which does not contemplate pecuniary gain of profit, incidental or otherwise, to its members". Therefore, your Petitioner prays your Honorable Court for leave to amend Paragraph 3 of said Petition Nune pro tune and to allow the addition thereto of the above recited statement.

And now, to-wit, September 25, 1947, the foregoing Petition having been presented, read and considered, it is hereby ordered and decreed that leave be granted to amend Paragraph 3 or the Petition for Incorporation of the Springfield Volunteer Fire Department Nune pro tune, and it is hereby ordered and decreed that Paragraph 3 of said Petition shall read as follows:

Third: The said Corporation is formed for the purpose of supporting and maintaining a fire engine, hookand ladder, and other fire fighting apparatus and hose company, for the control of fire and the protection of lives and property from fire in East Springfield Borough, Springfield Township, and the western portion of Girard Township, Erie County , Pennsylvania, and it is a Corporation which does not contemplate pecuniary gain or profit, incidental or otherwise, to its members.

The well worn patch of Bennett Daub, honored as a life member in 1975. He was born in 1917 at his long time home on Rt. 20 in West Springfield. He served 3 years in the Pacific Theater of Operations with the Army Air Force as an instrument mechanic.

Ben spent 31 years as a rural mail carrier in West Springfield with the U. S. Post Office retiring in 1981.
