Contractor Asks for $5,000 Check

Martin L. Schenker, who lost the contract for construction of the Erie county tuberculosis hospital through failure to provide a bond.Wednesday made formal application for return of the $5,000 certified check he posted with the county at the time he submitted his bid.The request was communicated through Attorney S. Y. Rossiter, representing the contractor.Willis said he will refuse to return the check until he is shown that he may do so legally. He planned to discuss the demand with county commissioners. The county retained the check, claiming it is entitled to $3,402 of if the difference between Schenkerís bid and that submitted by the Upton and Lang Co, which received the hospital contract.Attorney Rossiter, in his communication to Willis, said the county had not been damaged through Schenkerís inability to provide the bond and that there is nothing in the specifications which would permit the county to retain the $3,402.Some definite action on the check is expected within the next few days.
