Agreement made March 3, 1881 by and between Nancy H. Poole widow of W.W. Poole and D. P. Poole and Albert Poole, sons of said W.W. Poole, and William McKay and Sarah his wife and S. N. Slater and Florence his wife, M. L. Page and Martha J. Page his wife and Nancy M. Poole.  The said Sarah, Florence, Martha J. and Nancy M. being daughters of the said W.W. Poole as follows.

            Whereas there has been some difficulty between the parties above named in regard to the settlement and division of the estate of the said W.W. Poole and all the parties to this agreement wish to make a pleasant and amicable settlement of all matters between them in regard to said estate.

            And whereas the said Nancy H. Poole, widow, for the purpose of making such amicable settlement is willing to leave her share and portion of said estate both real and personal and permit the same to be divided to and among her children on condition that each one of said children shall secure to her from and after the first day of April 1881 the payment semi-annually of the interest on the share or portion which each child may receive of said estate and which under the intestate laws the widow would be entitled to receive.  The principal of the personal estate and interest on the real estate and further if the said Nancy should require it for her comfortable support and maintenance that each heir should likewise secure and pay over to the said Nancy a proportionate or pro rated share of the money as received by each heir.  And the said Nancy to be the sole judge of what she may so need but she is to require of each heir an amount proportionate to the sum received by such heir and each heir to be responsible for his or her own share and not jointly and each heir is to secure to the said Nancy to her own satisfaction the annual interest as well as the proportionate share of the principal before such heir receives the money to which the said Nancy is entitled under the intestate laws.

            And whereas Albert Poole has been in possession for some years of a farm in Lake Township containing one hundred acres more or less, the deed for which was in the name W.W. Poole in his lifetime and the said Albert desires to retain said farm and the other parties are willing that he should do so and settle all questions as to title.

            Now, therefore, this agreement witnessed that the parties above named do hereby agree to and with each other and bind themselves severally to settle and adjust the estate of W.W. Poole both real and personal on the following basis.

            The said Albert Poole shall take and accept the farm in Lake Township on which he now resides at the sum or price of two thousand dollars and the other heir shall quite claim all their interest in said farm to him at said price.  The real estate in Sheakleyville and the lots in the borough of Sharon shall be sold as soon as convenient and at the highest price that can be obtained for the same and all the parties herein shall unite in making title to the purchases as soon as the same can be sold then the entire estate taking the Lake Twp. farm at the price above mentioned and the Sheakleyville and Sharon property at whatever the same can be sold for and all the personal estate shall be added together and make a gross sum constituting the entire estate.

            This entire estate as mentioned above shall then be divided into two equal shares and one share to wit: one-half shall be divided equally between D. P. Poole and Albert Poole, the two sons.  The said Albert retaining his farm on his share at the price above stated and the other share or half of said estate shall be divided equally between Sarah, Florence, Martha J., and Nancy M, the four daughters above named, and the said Martha Jane Page is to be charged with her note of $900, which is to be considered part of said estate, and the said D. P. Poole is to be charged interest on any money that has been loaned to him or paid for him by his father.

Before the subscriber, a Justice of the Peace in and for said County, personally came Nancy H. Poole, D.P. Poole, Albert Poole and Nancy M. Poole and acknowledged the above and foregoing agreement to be their act and deed for the purposes therein mentioned and as such desired it might be recorded.
