WILL
OF ALBERT POOL
I, Albert Pool, do on
this 28th day of November A.D. 1899 make my last will and
testament as follows. I bequeath unto my wife Mahala
the use of the old homestead with all the household goods and farm
implements, stock of all kinds, and crops in ground and the barn her
lifetime. I bequeath unto my
son William the sixty acres I formerly purchased from Hoover
White and Thompsons and where her
formerly lived before moving to the Zahniser
farm. I also will that my
executors dispose of my interest in Middlesex property within two years
after my death or at any other time agreed upon by the beneficiaries
should they think it best to hold said property longer than the two years
at the best possible advantage and proceeds of sale to be divided equally
between or among the following children:
Caroline Zahniser, Winfield Scott Pool,
Arminta Brocklehurst, Reuben Pool, Bertie Pool and Herman
Pool. At the death of
my wife Mahala, I will that my old homestead
above mentioned be sold also all household goods, farm implements, crops
and proceeds of said sale to be divided equally among my children:
William Pool, Caroline Zahniser, Scott Pool,
Arminta Brocklehurst, Reuben Pool, Bertie Pool and Herman
Pool.
I appoint my sons William
and Herman to be the executors of my will.

Whereas, we, the undersigned heirs of Albert Pool
are informed and believe that there was an agreement between our father, Albert
Pool and our mother, Mahala Pool, that
our said father would bequeath to our said mother, Mahala
Pool, all his personal estate for life also balances on books and
accounts, notes, checks and bank account etc., and that our said mother
agreed in consideration whereof to pay the debts against our said father's
estate and,
Whereas, we believe by oversight our said father in his will
omitted to name as bequests to our said mother the notes, books of
account, checks, money in bank as per said agreement; It is therefore
agreed by and between us, the undersigned children and heirs of Albert
Pool, Deceased that William Pool, the
executor of the estate of Albert Pool shall
turn over to the said Mahala Pool, our
mother, all notes, books of account, checks, cash on hand and in bank in
accordance with the agreement aforesaid between our father and mother and
we hereby relinquish any and all claim we have or may have against the
same, in consideration however, of her paying all debts against the estate
of said Albert Pool.
This agreement to be held by the executor, William
Pool until he is assured that the debts of the said Albert
Pool have been paid.
