THIS INDENTURE, made the Sixteenth day of November in the year of 0ur Lord one thousand nine hundred and fifty three
BETWEEN SCHOOL DISTRICT OF THE TOWNHIP OF DRUMORE, a Fourth Class School District under the laws of the Common-wealth of Pennsylvania, of the Township of Drumore, County of Lancaster and state of Penn-sylvania, party of the first part and HILARY W. SHEETS AND ETHEL SHEETS, husband am wife, of the Township of Drumore, county of Lancaster and State of Pennsylvania, parties of the second part: WITNESSITH, That the said party of the first part, for and in consideration of the sum of Twenty three hundred and fifty dollars ($2350.00), lawful money of the United States of America, well and truly paid by the said parties of the second part to the said party or the first part, at and before the ensealing and delivery of these presents ,the re-ceipt whereof is hereby acknowledged, has granted bargained, sold, aliened, enfeoffed, released, conveyed and confirmed and by these presents does grant ,bargain, sell, alien, enfeoff, release, convey and confirm unto the said parties of the second part, their heirs am assigns, as tenants by the entireties, with the right of survivorship and to the survivor of them.
ALL THAT CERTAIN tract of land situate at the northeast corner of the intersec-tion of the road 'leading from Chestnut Level to Fairfield, and the road leading from Mechanic Grove to Fairfield at the south edge of the Village of Chestnut Level, in Drumore Township, Lancaster County, pa, on which is erected a one story frame school house and other improve-ments, known as the Chestnut Level School, bounded and described as follows:
BEGINNING AT A STONE in the road leading from Chestnut Level to Fairfield a corner of land of Hilary W. Sheets, et ux, formerly land of A. S. Clark; thence along the same south two and three quarter degrees east, seven perches (S. 2 3/4 deg. E. 7 P.)to a point at or near the intersection "of the above mentioned road and a road leading from Mechanic Grove to Fairfield; thence in and along said last mentioned road and by land of Ross McCauley, north seventy one degrees east thirteen perches (N. 71 deg. E. 13 P. )to as tone, a corner of property late of Mary Ann Bishop, now of Leonard Sprout; thence leaving said road and along land of said Leonard Sprout, north twenty seven degrees west, thirteen and five tenths per ches (N.27 deg. W. 13.5 P.) to a stone in the public road leading from Chestnut Level to Fairfield; thence in end along said ,road and by land of Frank Eckman and Hilary W. Sheets, et ux, respectively south thirty five and three quarter degrees west, eleven perches (S. 35 3/4 deg. W.11 P.) to a stone the place of beginning. .Containing ninety perches of 1and,more or less. BEING the same premises which Mary Ann Bishop, widow ,by deed dated May 7, 1887 and recorded in the Recorder of Deeds', Office in and for the County of Lancaster,Pa. in Deed Book T, Vol. 12,page 321,granted and conveyed unto Drumore School District ,it s 'successors and assigns. The within deed is executed pursuant to a resolution of the Board of Directors of the School District of Drumore Township adopted at a regular meeting held on September 25, 1953, authorizing the public auction of t he within described real estate a nd in pursuance of said Resolution the above described real estate was advertised for public auction in the Lan-caster Lew Review under dates of October 9,16 and 23rd, 1953,and in the Quarryville Sun under dates of October 9, 13, 20 and 30,1953, and by hands bills posted on the real estate to be sold, and at five of the most conspicuous places in the vicinity of said real estate, as provided by t he Public School Code of 1949 Act of March 10,1949, P.L.30 Article VII Sect.707 ,as amended, (24 P.S. 7-707), and at said auction held on Saturday October 31,1953 at 2:00 o'clock P.M. on the premises, said real estate was sold to the said Hilary W. Sheets and Ethel Sbeets, husband and wife for the SUM of Twenty three hundred and fifty dollar's ($2350.00) that being t re high-est and best price bid at said auction; and by Resolution of the Board of said School Direc-tors adopted a t a meeting held on October 31, 1953, the President and Secretary were auth-orized to execute, acknowledge and deliver a deed for said real estate to the purchasers there of upon receipt of the purchase money, and that said premises are vacated and abandoned and are no longer necessary for school purposes. TOGETHER WITH all and singular the bui1dings,improvements,woods,ways, streets, alleys, passages, rights, liberties, privileges, hereditaments and appurtenances ,to the same belonging, or in any wise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and of every part and parcel thereof: AND ALSO, a11 the estate, right, title, interest, property, possession, claim and de-mand whatsoever, both in law and equity, of the said party of the first part, of, in and to the said premises, with the appurtenances: TO HAVE AND TO HOLD the said premises wit'1 all 8I1d singular the appurtenances, tract of land above described with the improvements that eon erected, unto the said parties of the second part, their heir's and assigns, to the only proper use, benefit and behoof of the said parties of the second part ,their heirs, and assigns forever as tenants by the entireties, with the right of survivorship and to the survivor of them.
AND the said School District of the Township of Drumore, its successors, executors and administrators, does by these presents, covenant, grant and agree to and with the said 'parties of the second part, their heirs and assigns forever ,that it, the said School District ' of t he Township of Drumore, its successors all and singular the heredtiaments and premises herein above described and granted, or mentioned and intended So to be, with the appurtenances, unto the said parties of the second part, their heirs and assigns, against it, the said School District of the Township of Drumore, its successors and against all and every other person 01' persons whomsoever lawfully claiming or to claim the same or any part thereof, by, from or under it, him, her', them or any of them, shall and will warent and forever defend.
