Barclay to Bare,

THIS INDENTURE Made the 26th day of October in the year of our Lord one thousand seven hundred and fifty nine BETWEEN Hugh Barclay of the Township of Colrain in the County of Lancaster & Province of Pennsylvania yoem. Of the one part and Jacob Bare of Bart Township in the county and Province aforesaid of the other part. WHEREAS the Honourable the Propietarys of this Province in & by their certain Deeds of Lease and Release bearing date the second & third days of December 1681 did grant & confirm unto John King & to his heirs &ca. the quantity of one thousand acres of land to be survey'd in said Province which said lands &ca. After his decease descended to his daughter Alice the wife of Joshua Hart being the only surviving heirs of said John King which said thousand acres of land by virtue of a warrant from the Land Office was survey'd & laid our on the branches of Pequea Creek then in Chester county but since the devision, now in Lancaster County, & return'd the 17th of April 1716 AND WHEREAS the said Joshua Hart & Alice his wife did by their deed convey the said lands & premises to Richard Robinson & to his heirs &ca. who granted & confirmed the same to Sir William Keith & to his heirs &c. forever and the said Sir William Keith granted & confirmed the same to John Kyle & to his heirs & assigns forever and the said John Kyle by his Indenture of the tenth day of November 1735 did grant & confirm two hundred & ten acres part of the same thousand acres of land unto James Murphey & to his heirs &c. who TOGETHER WITH Elenor his wife by their certain Indenture bearing date the 21st Day of February 1745 did grant & confirm the same with the appurtenances unto the above named Hugh Barclay and to his heirs & assigns forever, under the certain bounds & limits and for the consideration their mentioned relation to the same and to the severall above in part recited conveyances being had may more fully and at large appear NOW THIS INDENTURE WITNESSETH That the said Hugh Barclay in consideration of the sum of thirty pounds lawfull money of the Province to him in hand paid by the said Jacob Bear before the ensealing & delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained & sold aliened remised released enfoeffed and confirmed, and by these presents doth grant bargain & sell allien remise release and confirm unto the said Jacob Bear and to his heirs and assigns ALL THAT CERTAIN lot, part or parcel of the said above mentioned lands & premises bounded & described BEGINNING at a stone set for a corner and from thence extending by the other lands of said Hugh Barclay North sixty six degrees Westerly sixty eight perches to a white oak and North ten perches to a white oak thence by other lands South eighty one degrees Easterly sixty one perches to a post in the line of the other lands of the said Jacob Bear South three degrees Easterly twenty eight perches to the place of beginning CONTAINING seven acres & the usual allowance with all & singular the buildings improvements, orchards gardens meadows fields woods water watercourses sluces, floodgates, banks trenches, ditches roads, rights members hereditaments and appurtenances, and all the estate or estates right, title, interest, use liberty property claim or demand whatsoever of him the said Hugh Barclay his heirs or assign of in or to the same belonging or in anywise appertaining and all the reversion and reversions remainder and remainders thereof and true copies of all deeds evidences & writings relating or concerning the same to be had & taken at the proper costs of the said Jacob Bear his heirs & assigns TO HAVE AND TO HOLD the said bargained seven acres of land hereditaments and premises herein granted bargained & sold mentioned or intended so to be with the appurtenances unto him the said Jacob Bear his heirs or assigns to the only proper use and behoof of him the said Jacob Bear his heirs and assigns forever Subject and under a proportionable part of the yearly quitrents &ca. To become due to the Honourable the Proprietaries and their successors and to no other covenant clause condition alteration or change whatsoever except what appears on these presents

IN WITNESS WHEREOF the partys to these presents have hereunto set their hands & seals interchargeably the day & year first above mentioned Sealed and delivered in the presence of Hugh Black- Conrad Baumen(German)

RECEIVED THE DAY OF THE DATE OF THE ABOVE Indenture of & from the above named Jacob Bear the sum of thirty pounds in full for the consideration money above mentioned. Hugh Barclay {seal} The 26 day of October 1759 before me the subscriber one of the Lancaster County Magistrates personally came the above named Hugh Barclay in the above Indenture mentioned and acknowledged the same to be their act & deed and desired that the same might be recorded accordingly IN TESTIMONY WHEREOF I have hereunto set me hand & seal Andrew Work {seal}
