Daniel HERBERT To Robert CALDWELL

This Indenture Made the Twenty fifth day of September A. Dom. One thousand seven hundred and Eighty four Between Daniel HERBERT of Leacock Township in the County of Lancaster and State of Pennsylvania Yeoman of the one Part and Robert CALDWELL of Salsbury Township in the County of Lancaster aforesaid Yeoman of the other part. Witnesseth that the said Daniel HERBERT for and in Consideration of the Sum of one hundred & fifty Pounds six shilling & three pence to him him Hand well and truly paid by the said Robert CALDWELL at and before the Sealing and Deliver hereof (the Receipt and Payment whereof is hereby acknowledged) Hath granted bargained and sold aliened enfeoffed released and confirmed and by these presents Doth grant bargain and sell alien enfeoff release and confirm unto him the said Robert CALDWELL his Heirs and Assigns. All that certain tract or Piece of Land situate lying and being in Leacock Township in the County of Lancaster aforesaid bounded and described as follows Viz: Beginning at a post standing on the side of the Great Road leading from Lancaster to Philadelphia, thence along the same Road North eighty seven degrees West One hundred and ten perches to a Hickory Tree thence by William WALLACE'S Land South twenty four degrees East ninety perches and a half to a Stone, thence by Lands of William HUSTON North fifty two degrees East ninety one perches to a post, thence by Lands of Thomas PINKERTON North West about twenty five perches to the Place of Beginning Containing Thirty two acres two quarters and twenty two perches of Land (be the same more or less). It being part of a larger Tract of One hundred & three acres & allowance which the Proprietaries of Pennsylvania by their Patent dated the twenty seventh Day of November A. Dom. One thousand Seven hundred and forty two and recorded Philadelphia in Patent Book A Vol. 10 page 538? 6 did grant and confirm unto John ROUX his Heirs and assigns forever. And the John ROUSE by his Indenture dated the twenty third Day of June A. Dom. One thousand Seven hundred and Seventy nine did grant and confirm the said larger Tract unto James MERCER his Heirs & assigns forever. And the said James MERCER and Margaret his by their Indenture dated the seventeenth Day of March A. Dom. One thousand seven hundred and Eighty did grant and confirm the same unto the said Daniel HERBERT his Heirs & Assigns forever as by the said Patent and Indenture may more fully and at large appear Reference thereunto being had. Together with all and singular the Houses Out-houses Edifies and Buildings thereon erected and being Ways Waters Water Courses, Woods Trees Fences, Gardens Orchards Meadows Paths, Passages, Rights, Liberties, Priviledges, Advantages, Hereditaments and Appurtenaces, and whatsoever thereunto belonging or in any wise appertaining, and the Reversion and Reversions Remainder and Remainders Rents, Issues and Profits thereof, and all the Estate Right Title Interest use Trusts Property Claim and Demand at Law and in Equity, or otherwise howsoever of him the said Daniel HERBERT and his Heirs of in and to the same or any Part thereof. To Have and to hold the said above described Tract of Thirty two acres Two quarters and twenty two perches of Land (more or less) Hereditaments, and Premises hereby granted and released (or mentioned or intended so to be) with the appurtenances unto the said Robert CALDWELL his Heirs and assigns. To the only proper use Benefit and Behoof of him the said Robert CALDWELL his Heirs and Assigns forever. Subject to a proportionable part of the Yearly Quit Rent due and to become due thereon to the Chief Lord or Lords of the Fee thereof. And the said Daniel HERBERT for himself his Heirs Executors and Administrators convenants and grants to and with the said Robert CALDWELL his Heirs and Assigns that he the said Daniel HERBERT his Heirs Executors and Administrators the said above described Tract of Land & Premises with the appurtenances hereby granted and released (or mentioned or intended so to be) unto the said Robert CALDWELL his Heirs and assigns against him the said Daniel HERBERT and his Heirs and against all and ever other Person and Persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrant and forever defend by these Presents. And further that he the said Daniel HERBERT and his Heirs shall and will from Time to Time and at all Times hereafter upon the reasonable Request of him the said Robert CALDWELL his Heirs and assigns make do & execute or cause and procure to be made done and executed all and every such further and other acts Deeds or assurances whatsoever in the Law for the further measure and perfect granting & confirming the said Tract or Parcel of Land and appurtenances unto the said Robert CALDWELL his Heirs and assigns forever as by him or them or his or their Councils learned in the Law shall be reasonably advised devised and required.

In Witness whereof the Parties to these Presents have hereto interchangeably set their hands and seals the Day and Year first above said. Daniel HERBERT (Seal) Sealed & delivered in the Presence of us.

Lancaster County This twenty fifth Day of September A. Dom. 1784 Before me the Subscriber one of the Justices of the Court of Common Pleas in and for the County of Lancaster appeared the within named Daniel HERBERT and acknowledged the within Indenture to be his act and Deed and desired that the same might be recorded as such recording to Law. Witness my Hand and Seal the Day and Year above said.
