Daniel HERBERT To Andrew CALDWELL

This Indenture Made the Ninth Day of September in the year of our Lord One thousand seven hundred & Eighty four. Between Daniel HERBERT of Leacock township in the County of Lancaster & State of Pennsylvania Yeoman of the one Part and Andrew CALDWELL of the Township of Leacock in the County of Lancaster & State aforesaid yeoman of the other Part. Witnesseth that the said Daniel HERBERT for and in Consideration of the Sum of Two hundred & six pounds & five Shillings Specie to him in Hand well & truly paid by the said Andrew CALDWELL at or before the Sealing and Delivery hereof the Receipt & Payment whereof is hereby acknowledged and from every part and parcel thereof doth acquit & for ever discharge the said Andrew CALDWELL his Heirs and assigns forever by these Presents Hath granted bargained sold aliened remised enfeoffed released and confirmed and by these Presents Doth grant bargain sell alien remise enfeoff release & confirm unto the said Andrew CALDWELL and to his Heirs & assigns all that certain Tract or Parcel of Land situate lying & being in Leacock Township in the County of Lancaster aforesaid bounded & described as follows viz

Beginning at a Spanish Oak thence by Lands of William SKILES South nineteen degrees West forty two perches to a Hickory South sixteen degrees West thirty one perches to a post, thence by Thomas PINKERTON'S Land South eighty nine degrees East fourteen perches to a Stone North fifty two degrees East eighteen perches to a post South seventy degrees East twenty one perches thence by Andrew CALDWELL'S other Land North sixty degrees and a half East eighty one perches to a post thence by Henry SKILES Land North two degrees West thirty nine perches to a stone & South eighty three degrees West one hundred & one perches to the Place of Beginning containing Forty one acres one quarter & six perches of Land be the same more or less. It being part and parcel of a larger Tract of Land which the Proprietaries of Pennsylvania by their patent (link to this patent record)bearing Date the Twenty seventh Day of November in the year of our Lord One thousand seven hundred & forty two and recorder at Philadelphia in Patent Book A Vol. 10 page 53 did grant & confirm unto John ROUSE his Heirs & assigns for ever. And the said John ROUSE by his Indenture dated the twenty third Day of June D. Dom. 1779 for the Consideration therein mentioned did grant & confirm the same Tract of Land unto James MERCER his Heirs & assigns forever. And the said James MERCER & Margaret his Wife by their Indenture dated the seventeenth Day of March A. Dom. 1780 for the consideration therein mentioned did grant & confirm the same Tract of Land unto the said Daniel HERBERT (Party hereto) & to his Heirs & assigns forever as by the said Patents & Indentures may more fully & at large appear. Together with all & singular the Houses Out Houses Edifices & Buildings thereof erected & built. Ways Waters Water Courses Woods Trees Fences Profits Commodities Hereditaments & appurtenances whatsoever thereunto belonging or in any wise appertaining and the Reversion & Reversions Remainder & Remainders Rents Issues Profits thereof and all the estate Right Title Interest Use Trust Property Claim & Demand of him the said Daniel HERBERT and his Heirs of and in the said Premises hereby granted or mentioned or intended so to be with the appurtenances. To have and to hold the said above described Tract or Piece of Land, Hereditaments & Premises hereby granted & released or mentioned or intended so to be with the appurtenances unto the said Andrew CALDWELL his Heirs & assigns To the only proper use Benefit & Behoof of him the said Andrew CALDWELL his Heirs & assigns forever. Subject to a proportionable part of the Quit Rent if any now due & hereafter to become due for the same to the Chief Lord or Lords of the Fee thereof. And the said Daniel HERBERT doth for himself and his Heirs the said Tract or Parcel of Land Hereditaments and Premises hereby granted (or meant mentioned or intended so to be) with the appurtencances unto the said Andrew CALDWELL his Heirs and assigns against him the said Daniel HERBERT & his Heirs and against all & every other Person & Persons whomsoever lawfully claiming or to claim the same or any Part thereof shall & will warrant & forever defend by these Presents. And the said Daniel HERBERT and his Heirs and every other Person or Persons whosoever their Heirs anything having or lawfully claiming of or in the Hereditaments & Premises hereby granted or any part thereof shall & will at any Time or Times hereafter upon the reasonable Request of him the said Andrew CALDWELL his Heirs & assigns make do & execute or cause to be made done & executed all & every such other and further acts Deeds or assurances whatsoever in the Law for the further better more sure & perfect granting & confirming the said Tract of Land with the appurtenances for the use & Purpose herein mentioned as by him the said Andrew CALDWELL his Heirs and assigns or his or their Council learned in the Law shall be reasonably advised devised or required In Witness whereof the said Parties to these Presents have interchangeably set their Hands & Seals the Day & Year first above written.

Received on the Day of the Date of the above written Indenture of the above named Andrew CALDWELL the Sum of Two hundred & six Pounds & five shillings Specie in full for the Consideration Money above mentioned

Lancaster County, Be it remembered that on the Day 9th Day of September A. Dom. 1784 personally appeared before me the Subscriber one of the Justices of the Court of Common Pleas for the County aforesaid the above named Daniel HERBERT and acknowledged the above Indenture to be his act & Deed and desired that the same might be recorded according to Law. In Testimony whereof I have hereunto set my Hand & Seal this Day above said.
