archives BuildingSouthern Lancaster County Historical Society HERBERT Lancaster County, Pennsylvania Deed Book T, Vol. 1, pg. 93 JACOB HERBERT To Amos STRETTEL This Indenture made the Twenty seventh Day of December in the year of our Lord one thousand Seven Hundred and Seventy five Between Jacob HERBERT of Leacock Township in the County of Lancaster, Blacksmith of the one part and Amos STRETTLE of the City of Philadelphia and province of Pennsylvania Esquire of the other part. Whereas the said Jacob HERBERT in and by a Certain Bond or obligation duly Executed bearing Even date herewith standeth in the penal sum of Four Hundred Pounds Lawful Money of Pennsylvania Conditioned for the payment of two Hundred Pounds like Money with Lawful Interest for the same on or before the Twenty Seventh day of December next ensuing the Date hereof as by the said bond or Condition Reference thereunto being had may more fully appear. Now this Indenture Witnesseth that the said Jacob HERBERT for and in consideration of the aforesaid Debt or sum of two hundred pounds and for the better securing the Payment there of with its Interest unto the said Amos STRETTELL his Executors Administrators and Assigns as of the further sum of five shillings lawful Money aforesaid unto the said Jacob HERBERT In hand paid by the said Amos STRETTELL at or Before the Sealing and Delivery here of the Receipt of which five shillings is hereby acknowledged Hath granted bargained Sold released and confirmed and by these presents the said Jacob HERBERT Doth grant bargain sell release and confirm unto the said Amos STRETTELL A certain tract or piece of Land Situate Lying and being in the Township of Leacock afforesaid. Beginning at a Hickory Corner of land of James MONTGOMERY thence by the same North two hundred and eighteen perches to a Post thence West Seventy two perches to a post thence South one Hundred and forty four perches to a post thence west twelve perches to a marked Black Oak South nine Degrees West Thirty six perches to a post South thirteen Degrees East Eight perches to a marked White Oak in a line of George MACKRALL'S land thence by the same North seventy seven degrees East Forty three perches to the Place of Beginning Containing one Hundred Acres and an allowance of three acres _____ [It is the same Tract or piece of Land which Stewart HERBERT of Leacock Township Lancaster County and Province aforesaid Yeoman and Sidney his wife by Indenture bearing Date the Eighth Day of December 1775 for the consideration therein mentioned did Grant and confirm unto the said Jacob HERBERT and to his Heirs and Assigns forever] Together with all and singular the Buildings Improvements Rights Members and appurtenances there to belonging or appertaining and all the Estate Right Title Interest Property Claim and Demand whatsoever either in Law or Equity of him the said Jacob HERBERT of in and to the premises hereby granted and Every part thereof and the Reversions Remainders Rents Issues and profits there of To Have and to hold the said Tract or piece of Land Hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Amos STRETTELL his Heirs and Assigns to the only proper use and Behoof of the said Amos STRETTEL his Heirs and assigns forever under the proportionable part of the Yearly Quit rent hereafter to accrue for the hereby granted Premises unto the Chief Lord or Lords of the fee thereof Provided always never the less that if the said Jacob HERBERT his Heirs Executors administrators or assigns shall and do well and Truly pay or cause to be paid unto the said Amos STRETTELL his Executors Administrators or assigns the aforesaid Debt or sum of two Hundred Pounds on the day or time herein before mentioned and appointed for payment____ of together with lawful interest for the same according to the Condition of the said recited obligation without _____ or further delay and without any Defalcation or abatement? of anything or in respect of any Taxes charges or assessments whatsoever that then and from thence forth this present Indenture and the Estate hereby granted as the said recited obligation shall become void anything herein before contained is the contrary in any wise not with standing . In Witness whereof the said parties to theses Presents have interchangeably set their Hands and Seals hereunto Dated the Day and Year first herein written.
