Daniel PENNINGTON To Abner Davis

This Indenture Made the twelth day of June in the year of our Lord eighteen hundred and eleven Between Daniel PENNINGTON of Colerain Township in the County of

Lancaster and Commonwealth of Pennsylvania, Taylor and Oliva, his wife of the one part and Abner DAVIS of the Township County and State aforesaid Cordwainer of the other part.

Witnesseth that the said Daniel PENNINGTON and Oliva his wife for and in consideration of the sum of three hundred dollars lawful money of the United States to them in hand well and truly paid by the said Abner DAVIS at and before the sealing and delivery hereby acknowledge and thereof acquit and forever discharge the said Abner DAVIS his heirs Executors and administrators by these presents have granted bargained sold Aliened enfeoffed released and confirmed, and by these presents do grant bargain sell, alien, enfeoff Release and confirm unto the said Abner DAVIS and to his heirs and assigns A certain Lot or parcel of Land situate in the township of Colerain County of Lancaster aforesaid.

Beginning at a Black Oak Stump thence by Lands of John SCOTT south fifty nine and three fourths degrees East forty two and two tenths perches to a post South five and an half degrees West twenty four perches to a post thence by Lands of John PENNINGTON thence North eighty two degrees West fifty five and an half perches to a white oak stump thence South fifty four and three forths (sic) degrees West thirty perches to a post thence South thirty three degrees East one hundred and four perches to a post thence South fifty four degrees and three forths (sic)degrees West twenty five and four tenths perches to a post thence by Lands of David MILLER by a Chesnut tree a sassafras and a black oak North thirty three degrees West one hundred and nineteen perches thence by Land of Alexander RUSSEL deceased North fifty two and three forths (sic) degrees East fifty eight perches to a chestnut tree thence North fifty and one half degrees East thirty five perches to the place of Beginning containing thirty three acres one Rood (sic) and seven perches strict measure.

Together with all and singular the houses buildings Gardens orchards woods meadows ways waters water courses Rights Liberties privileges hereditaments and appurtenances what so ever there unto belonging or in any appertaining (subject never the less to the payment of the purchase Money and Interest due and to become due to the Commonwealth for patenting) and the reversions Remainders rents Issues and profits there of also all the Estate Right Title interest use possession property claim and demand what so ever as well at Law as in equity or otherwise of them the said Daniel PENNINGTON and Oliva his wife of into or out of the same.

To Have and to hold the said described Lot or parcel of land hereditaments and premises hereby granted with the appurtenances (subject as aforesaid) unto the Abner DAVIS his heirs and assigns to the only proper use and behoof of the said Abner DAVIS his heirs and assigns forever And the said Daniel PENNINGTON for himself his heirs executors and administrators doth promise grant and agree to and with the said Abner DAVIS his heirs and assigns by presents that he the Daniel PENNINGTON his heirs the said described Lot or parcel of Land hereditaments and premises hereby granted with the appurtenances subject as aforesaid unto the said Abner DAVIS his heirs and assigns against him the said Daniel PENNINGTON and Oliva his wife and their heirs and against all and every other person and persons whomsoever lawfully claiming or to claim by from or under him her them or any or either of them shall and will warrant and forever defend by these presents and the said Daniel PENNINGTON for himself his heirs Executors and administrators doth covenant promise grant and agree to and with the said Abner DAVIS his heirs and assigns by these presents that he the said Abner DAVIS his heirs and assigns shall and Lawfully may from time to time hereafter peaceably and quietly have hold use and occupy possess and enjoy the said Lot message or tenament hereditaments and premises hereby granted or mentioned intended so to be with the appurtenances without the Lawful ___?__ trouble hinderance or molestation of the said Daniel PENNINGTON and Oliva his wife their heirs or assigns or of any person or persons what so ever by or with his there or Either of their act means consent privily or procurement.

In Witness whereof the said parties to these presents have hereunto interchangeably set there hands and seals dated the day and year first above mentioned.

Received the day of the date of the above and afore written Indenture of and from the above named Abner DAVIS the sum of three hundred dollars lawful money of the United States being the full consideration money mentioned.

Lancaster County on the twelth day of June Anno Domino one thousand eight hundred and Eleven Before me one of the Justices of the peace in and for the County of Lancaster came the above named Daniel PENNINGTON and Oliva his wife and severaly acknowledged the within Indenture as and for their act and Deed and desired that the same might be recorded as such according to Law. She the said Oliva being of full age separate and apart from her said Husband by me Examined and the full contents thereof made known to her voluntarily consenting there to. In Testimony whereof I have here unto set my Hand and Seal the day and year aforesaid.
