Patent to Stewart HERBERT

Thomas PENN and Richard PENN, Esquires true absolute Proprietaries and Governors in Chief of the Province of Pennsylvania and Counties of Newcastle, Kent and Sussex upon Delaware. To all unto whom these presents shall come Greeting Whereas by virtue of a Warrant under the Seal of the Land __?_ bearing Date the twenty first Day of November One thousand seven hundred and forty three thence was Surveyed by John ?SOWER of the County of Lancaster Yeoman A certain tract of land Situate in Leacock Township in the said County bounded and described as follows. Viz: Beginning at _?__ marked white oak Thence by land of Anthony PRESOR South one hundred and fifty one Perches to a Post Thence by Land of Joseph and Conrad REITER West by South one hundred and fifty two Perches to a Spanish Oak marked, Thence by Job? BECKLER'S Land North by East one hundred and two perches to a marked Black Oak Thence by Land of Baltzer? REASONER East North East Ninety Perches to a marked white Oak and North East Sixty five perches to the Place of Beginning Containing ninety three acres and the usual allowance of six ___ ___ for Roads and Highways As in and by the Survey here of remaining in our Surveyor General's Office and from thence Certified into the Secretaries office may appear. And the said John SOWER by his Deed did Bargain and sale Dated the 26th Day of March 1745 for the Consideration therein mentioned did grant bargain Sell the above described Tract and premises unto Jacob EBBY in Fee and the said Jacob EBBY by his Deed did Bargain and Sale Dated the 29th Day of April one thousand seven hundred and forty five for the Consideration there in mentioned did grant bargain and sell the said Tract and Premises unto Hermon ?SHIN in Fee who by his deed of Bargain and Sale Dated the Seventh Day of March 1745 for the consideration therein mentioned did grant bargain and sell the Tract and Premises unto Mathew McCORKELL in Fee who by his Deed of Bargain and Sale dated the fourth Day of September 1753 for the consideration there in mentioned did grant and bargain and sell the said Tract and Premises unto Stewart HERBERT to hold to him his Heirs and Assigns forever Now at the Special Instance and bequest of the said Stewart HERBERT that we would be pleased to grant him a confirmation of the said Tract Know ye that in Consideration of the Sum of fourteen pounds eight Shillings and three pence lawfull Money of Pennsylvania to our use paid by the said Stewart HERBERT (the receipt whereof we hereby acknowledge and there of Do acquit and forever Discharge the said Stewart HERBERT his heirs and assigns by these Presents) And of the Yearly Quit Rent herein after mentioned and reserved. We Have given granted released and confirmed and by these Presents for us our Heirs and Assigns Do give grant Bargain Sell release and Confirm unto the said Stewart HERBERT his Heirs and Assigns the said Ninety three acres of Land as the same are now set forth Bounded and limited as aforesaid With all Mine Minerals Quarries Meadows Marshes Savannas Swamps Cripples Woods Underwoods Timber and ? Ways Waters Water Courses Liberties Profits Comodities Advantages Hereditaments and appurtenances what so ever thereunto belonging or in any wise appertaining and lying within Bounds and Limits aforesaid Three full and clear fifth Parts of all Royal Mines free from all Deductions and reprisals for Digging and Refining the same and also one fifth part of the Ore of all other Mines Delivered at the Piles Mouth only accepted and hereby reserved And also free Leave Right and Liberty to and for the said Stewart HERBERT his Heirs and assigns to hawk hunt fish and fowl in and upon the hereby granted Land and Premises or upon any Part thereof To Have and to Hold the said Ninety three acres of Land and Premises hereby granted (except before excepted) with their appurtenances unto the said Stewart HERBERT his Heirs and Assigns To the only Use and Behoof of the said Stewart HERBERT his Heirs and Assigns for Ever To be Holden of us our Heirs and Successors Proprietaries of Pennsylvania as of Manor of Conestogoe in the County of Lancaster aforesaid in Free and Common Soccage by Fealty only in lieu of all other Services Yielding and paying the yearly unto us our Heirs and Surveyors at the Town of Lancaster in said County at or upon the first day of March in every Year from the first Day of March last ____ one half penny Sterling for every acre of the same in Value thereof in Coin Current according as the Each shall then be between our said Province and the City of London to such Person or Persons as shall from time to Time be appointed to receive the same and in Case of Non payment there of within nine Days next after the same shall become Due that then it shall and May be lawfull for us our Heirs and Successers out and their Receiver or Receivers into and upon the hereby granted Land and Premises to re enter and the same to hold and Possess untill the said Quit rent and all arrears thereof together with the Charges recurring by means of such non payment and rent be fully paid and Discharged.

Witness Robert __ MORRIS, Esq. Lieutenant Governor of the said Province by Virtue of Certain Powers and authorities to him for this purpose inter alia granted by the said Proprietaries hath hereunto set his Hand and caused the Great Seal of the said Province to be hereunto affixed at Philadelphia this 2nd day of June in the year of our Lord 1755 (or 1756) Twenty ninth year of the Reign of King George the second over Great Britain And the thirty ninth year of the said Proprietaries Government.
