Deceased TO ALL PEOPLE to whom this present writing may come (Be it known) that I James MILLER of ye Township of Leacock In ye County of Lancaster & Province of Pensylvania (sic) (Yeo) Having under my Consideration ye uncertainty of time hereon Earth & ye Usual Course unto which all mankind is Subject which is mortality and for avoiding future trouble have made this my last Will & testament which in Manner & form is as followeth Imp. I Do Request my Spirit unto ye Lord my Creator that gave it and do order that my Body be Decently Buried and also that my Just Debts & funeral Expencs (sic) be first paid and Discharged by my Exrs herein after mentioned out of my Estate.

Item I Give and Bequest to my Dear and well beloved wife Ruth the Sum of one hundred and fifty pounds good and Lawfull money of ye Province afforead (sic) or the value of it with a Bed and furniture to be of her choice.

Item I Give and Bequeath to my Son in Law Thomas MILHOUSE the Sum of Sixty pounds Lawfull Money as afforead (sic) or the Value of it (interlin'd in Or) together with three Iron Potts (sic) fire Shovel & tongs and ye hand Irons for ye fire.

Item I Give & Bequeath to my Son in law Thomas HIETT ye Sum of Sixty pounds of Lawfull money as afforesd (sic), or the Value of it.

Item I Give and Bequath (sic) to my Son in law Isaac JACKSONS Children (Viz), Thos. James, Kathrine William Isaac Nathaniel & Elizabeth ye Sum of Sixty pounds or ye Value of it of Lawfull money as afforesd (sic). To be Equally divided among them share and share alike.

Item I Give and Bequeath to my Son in law William JACKSON ye sum of Sixty pounds Lawfull money as afforesd (sic). Or ye Value of it.

Item I Give and Bequeath to my Son in law William FARGUER ye sum of Forty pounds Lawfull money as afforesaid or the Value of it.

Item I Give to my Son in law James JACKSON ten shillings or the Value of it and I do hereby order my Exes herein after mentioned to make Sale of my Estate Real and Personal

Except what is above mentioned to my wife and Son in law Thomas MILHOUSE and if my Estate shold (sic) fall Short of paying ye Legacies mention'd to my Children & Grandchildren it is my will that there shall be an Equall (sic) Deduction out of Each of their shares Except my Grandchildren mentioned aforesd (sic), who is but one Share there is to be but one Share Deducted and likewise if my Estate shold (sic) prove more or there shold (sic) be any Remainder It is my Will yt one third part thereof shold (sic) be given to my wife and ye Refsidue (sic) Equally Divided among ye Legatees afforsd (sic). Except my Grandchildren who is to have but one Childs part.

Lastly I Nominate Constitute and appoint my Son in Law William JACKSON and my son James MILLER both of Chester County In ye Province afforesd (sic) to be ye Exrs of this my Will Desireing (sic) they my (sic) see it Rightly & truly performed and I do hereby utterly Renounce Difsanull (sic) & make void all other and former Wills by me made declaring this & no other to be my Last Will & Testament IN WITTNEFS (sic) whereof I have hereunto Set my hand & Seal this second day of ye 4th Mo. 1748. Sign'd seald (sic) Published Pronounced & Declared by ye sd. Jame (sic) MILLER to be his Last Will and Testament In ye predsence (sic) of us before signing and sealing ye words (or the value of it) was interlined. Richard OWEN Benjamin OWEN

Lancaster County fs Personally appeared Richard OWEN and Benjamin OWEN the Witnefses (sic) to the within Will and upon their Solemn Affirmation Declared that they were present and saw and heard James MILLER the Testator Sign Seal Publish and declare the same as his last Will and Testament and that at the doing thereof he was of Sound and disposing mind and Memory to the best of these Affirmants knowledge and believe. 4th April 1749
