Thomas PENNINGTON Died March 26, 1877 at 12 o'clock in the afternoon as per affidavit filed: Attest: C. H. Fasnacht

I Thomas PENNINGTON of Colerain township in the county of Lancaster and State of Pennsylvania, being of sound mind and memory, do make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore made.___ First, I direct that my just debts and funeral expenses be paid by my executor herein after mentioned as soon after my decease as convenient: As to such estate as I may be possessed of at the time of my decease I dispose of the same as follows to wit:

Item, I give and bequeath unto my beloved wife, Anna PENNINGTON all my property whether Real, personal or mixed, except my wearing apparel and eight day clock, to have and to hold for her sole use, profit and ? during her natural life which property is to be in lieu of her dower at common law upon the payment of the sum of one dollar to each of my three sons, Robert H. PENNINGTON, Clinger PENNINGTON and Edgar PENNINGTON.

Item, I further will and devise that after the decease of my said wife that the said landed property shall be sold as soon as convenient and that the sum of one thousand dollars and my personal property or its proceeds shall be paid over by my Executor to whomsoever my said wife in her will may direct as I wish her to have the sole and entire disposal of the sum of one thousand dollars and of my personal property.

Item, I further will and devise that the sum of one hundred dollars be paid to Louisa G. PENNINGTON, wife of Robert H. PENNINGTON.__ Item I further will ahd devise that the remainder of my estate after these bequests shall have been made, shall be paid to my son Edgar PENNINGTON, and also my wearing apparel (soon after my decease) and my eight day clock.

Lastly, I appoint my Nephew, Simeon W. SWISHER the Executor of this my last will and testament. In witness whereof I have hereunto set my hand and seal the tenth day of the sixth month, A. D. one thousand eight hundred and seventy four.___ Thomas PENNINGTON

Signed, sealed, published and declared by the above named Thomas PENNINGTON to be his last will and testament in the presence of us who at his request and in his presence have subscribed our names as witnesses thereunto. Thomas BAKER Eliz. BAKER

Upon more mature consideration and with a sincere wish to divide my property equally among my children,___ I herewith annul and revoke the legacy of one hundred dollars to Louisa G. PENNINGTON wife of Robert H. PENNINGTON, witness my hand and seal this seventeenth day of sixth month A. D. one thousand eight hundred and seventy four. Thomas PENNINGTON

Lancaster County On the 14th day of April A. D. 1877 personally appeared before me Eliza BAKER who being duly affirmed according to law does say that she is well acquainted with the handwriting of Thomas PENNINGTON, the above named Testator and that she believes the signature to said codicil of said Thomas PENNINGTON there to ? his own proper and genuine handwriting and further ?? Eliza. BAKER

On the Fourteenth day of April 1877 before me the subscriber, personally appeared Thomas BAKER and Eliza BAKER the subscribing witnesses to the proceeding will and codicil and on their solemn affirmation did declare and say that they were present and saw said and heard Thomas PENNINGTON the testator therein named, sign, seal, publish, pronounce and declare the same to be his last will and testament and that at the time of the doing thereof he was of sound and well disposing mind, memory and understanding to the best of their knowledge, observation and belief. C. H. Fasnacht

April 14th 1877 Letters Testamentary granted to Simeon M. SWISHER the Executor named in the annexed will he being duly affirmed well and truly to Administer the goods and chattels rights and credits which ? the testator according to the law and also that he will diligently and faithfully regard and well and truly comply with the provisions of the laws relating to Collateral Inheritance.
