Upon the petition of Thomas Bailey heir at law of Thomas Bailey dec’d setting forth that Thomas Bailey the father of the petitioner died intestate leaving children and heirs as follows, to wit Mary intermarried with David Duvall, John Bailey, Henry Bailey, Martha intermarried with John Murphy, Hannah intermarried with John Shepland, Ruth intermarried with Noah Scott, Thomas Bailey your petitioner, Jemima intermarried with Joshua Jackman, Isaac Bailey and Sarah Bailey all resident in Washington County. That the said Thomas died seized in his demesne as of fee in and to a tract of land in East Pike Run Township adjoining Isaac Bailey and others containing Eighty acres more or less and therefore praying the court to award an Inquest upon the said land to make partition or valuation thereof according to law and make return thereof to the court accordingly. 

And now to wit, February 18th 1840 Inquest awarded March 4th 1840. Exit writ. August 18th 1840James Spriggs Exq High Sheriff returned his writ by which it appears that he did on the 27th day of March instant take with him twelve free and lawfull men of his bailiwick and go to and upon the lands and premises of which the said Thomas Bailey dec’d seized and then and there upon the oaths and affirmations of the men aforesaid did find that the same lands and tenements could not be parted and divided among the children of the said deceased without prejudice to or spoiling of the whole and the Inquest aforesaid on their oaths and affirmations aforesaid have valued and appraised said lands and premises, at and for the sum of $30.00 per acre-amounting in the whole to the sum of $2801-62 ˝ cents lawfull money of the United States, August 18th 1840 Inquisition confirmed and on motion of John L. Gow Esq. Rule of the heirs of said dec’d
appear on the first day of next term and accept or refuse the said Real Estate at the appraised valuation.


February 15, 1841 Thomas Bailey the eldest son and heir at law of Thomas decedent appears in Court and elects to take the real estate at the appraised valuation which is decreed to him by the commonwealth.


vz. David Duvall & John Williams The defendants bound jointly and severally in the sum of $5400 conditional that Thomas Bailey pay over to the other heirs and legal representatives within [a or one] from the date with interest their respective distributive shares in the same real estate taken by the same Thomas Bailey at the appraised valuation.

Acknowledged February 15, [ ?__ Ruple, clerk]

May 21st 1861 the court grant a Rule on Thomas Bailey to show cause on the first day of next term why he should not pay over the purports to the other heirs of Thos Bailey with int. June 8, 1861 rule issued.
