Will of Benjamin Kenney
Written 25 Aug 1838 Proved 14 Apr 1843
I, Benjamin Kenney, of the County of Washington and State of Pennsylvania, do make and publish this my last Will and Testament, hereby revoking and making void all former Wills by me at any time heretofore made. First and principally I commend my soul to God my creator humbly hoping that when this earthly tabernacle is laid down that my immortal soul will be wafted through the merits of Jesus Christ to a building eternal in the heavens, and as to such worldly goods as it hath pleased God to entrust me with:
First: I direct that all my just debts and funeral expenses be paid out of the first money that come into the hand of my Executor from the proceeds of my personal property.
Secondly: I will and bequeath unto my beloved wife Elizabeth the full and entire use of the tract of land whereon I now reside, together with all and singular the appurtenances thereunto belonging, for and during her natural life, subject to this restriction, that no undue waste be committed to them during said term.
Having previously provided for and made advancements to my two daughters, Margaret Hedge & Mary Rothwell, I therefore will and bequeath to each of them the further sum of fifty dollars to be paid within one year after the decease of my beloved wife Elizabeth.
I also give and devise unto my son Westly, subject to the bequest made to my beloved wife Elizabeth, the whole of the premises whereon I now reside so that he, at the time of her decease, may absolutely inherit the same and that he, immediately after my decease, inherit the part that is struck off from that I sold to my son James that was conveyed to me by Thomas Welsh Esq. At the decease of my widow Westly is to pay the sum of five hundred dollars to the estate.
I give to my daughter Rebecca Cook the sum of one hundred & fifty dollars to be paid as follows; one hundred within one year after my decease and fifty within one year after my widow’s decease.
I Will that the residue of my estate which is not herein disposed of that the same be sold and the surplus of the proceeds after carrying into effect this my last Will and Testament be equally divided amongst my children; Margaret, Mary, James, Westly, & Rebecca.
Lastly: I do hereby nominate and appoint my son James Kenney & George Hill Executors to this my last Will and Testament
In witness whereof I have hereunto set my hand and seal this 25th day of August in the year of our Lord one thousand eight hundred and thirty-eight Benjamin Kenney (seal)
Hand sealed and delivered in the presence of Lewis Freeman John Freeman
