Will of William Y. FERGUSON Filed in Chester County, South Carolina 27 Sep 1847 In the name of God, Amen. I William Y. Ferguson of State afore said being of sound and disposing mind & memory but weak in body and calling to mind the uncertainty of life & being desirous to dipose of all such worldly Estate as it has pleased God to bless me with do make and ordain this my last will in manner following, that is to say 1st I will and bequeath unto beloved wife Ann Ferguson all my real Estate and personal of all description during her natural life Except so much as will be necessary to pay what debts I may owe at the time of my decease and after her death I desire that property may be disposed of in the following manner Viz. 1st I will and bequeath unto my son Stephen Ferguson one sorell horse called doltes(?) which is now in his possession and also one hundred acres of land on the East or N East end of my plantation the Beaver Dam Creek running through it by the said Stephen paying of all the debt that I may there owe 2nd It is my will that the ballance (sic) of my land be equally divided amounst my three youngest sons Viz Adams Ferguson, Robert Ferguson and John Ferguson and in case either of them three should die before the(y) arrive at the age of 21 years or has any legal heirs of there body that his part shall be equally divided amongst the other one or two that may survive him. It is my will that the rright of thitle of sd legacies of land be vested in them and their heirs forever. 3rd I will unto my daughter Mourning Ferguson one bed and furniture one cow and calf and one sow and pigs or the worth of them. 4th I will and bequeath unto my daughter Ann Ferguson one cow and calf one xow and pigs and bed and furniture or the worth of them. 5thI will unto my daughter Susan five dollars 6thI will unto my daughter Elizabeth Bradley five dollars 7thI will unto my daughter Ellenor McCrory five dollars 8thI will and bequeath unto my daughter Agnes Ferguson one bed and furniture one cow and calf an on equal divide with my four sons of all my personal Estate of all description that may remain at the time of the death of my beloved wife Ann Ferguson. And lastly I constiture and appoint my wife A Ferguson adn my son Stephen Ferguson as executor of this my last will and testament and i desire that Stephen pays particular attention ttht Agnes receives her legacy. In testimony whereof I have hereunto set my hand and seal this 17th March AD 1840 Signed published and declared as and for the last of the above named Wm Y. Ferguson in prsence fo us who in prsence fo each other and at his request have witnessed the due execution of the same N. B. the two places of enterlining where the word of land and one cow inserted was done before signing. Signed John Ferguson William Y. Ferguson Samuel Ferguson Robert Ferguson South Carolina In the court of Ordinary, September 27th 1847 Chester District Personally came in open court John Ferguson who upon being duly sworn saith upon oath that he was present and saw William Y. Ferguson sign seal publish pronounce and declare the will in writing to be and contain his the said William Y. Ferguson last will and Testament and further saith the said William Y. Ferguson was then of sound and disposing mind memory and understanding to the best fo this deponents knowledge belief and further saith that he with Samuel A. Ferguson and Robert J. Ferguson did sign their names or witnesses thereto in the presence of each other and in the presence fo the testator and at his request Sworn to and signed date above John Ferguson Peter Wylie Ordy Will of Judith I. Montgomery Know all by those present that I Judith I Montgomery being of sound and disposing mind do make the following disposal of any Estate & effects that is to say Item first I give will and bequeath to my nephew Alexander M. Knighton the amount of Five hundred dollars to be paid him out of a note given to me by Daniel Hall, William E. Hale and Thomas McCullough for the sum of three thousand dollars payable ten years after with annual interest from the date thereof & dated January 3rd 1842 Item second I give will and bequeath to my nephew Jesse M. Wilson the sum of five hundred dollars to be paid him by my executors when he arrives at the age of twenty one years if he should live so long. If not it is my will and sdesire that the same be given to my nephew Jonathan Bellow Mickle and his heirs forever Item third I give will and bequeath to my nephew Jonathan Bellow Mickle the rest and residue of my Estate and effects consisting of and comprosing the ballance fo the net given me by Daniel Hall William E. Hale and Thomas McCullough: the notegiver me by G. B. Nomtgomery Junior for the sum of four hundred dollars dated 24th day of December 1844 adn the negro woman slave Ridley together with her (?) and increase forever. And I also will and direct and charge him to pay my husband Green B Montgomery Senior the full sum of Seventy five dollar at the end of each and every year for the term during his natural life. And I also constitute and appoint Alexander M. Adam Ferguson Jun'r Died Nov. 9, 1833 Aged 53 yr 7 mos and 15 days John Ferguson born April 4, 1793 Died June 26th 1859 William Y. Ferguson departed this life Aug. 26th 1846 age 72 yrs 1 mo. and 8 days Anna Ferguson died Dec. 22, 1850 age 57 yrs and 11 mos William Ferguson died Oct 28, 1874 aged 80 yrs 8 months and 2 d.
