Joseph Wells is probably the Joseph Wells served in the Company F of the Harlan County Battalion but the incident in the petition probably occurred later as the he refers to himself as a "United States soldier" not a state guard member. A search on the Civil War Soldiers and Sailors system turned up four possible Joseph Wells:
Any of the above are possibly this Joseph Wells. The 14th Infantry certainly served and had operations in southeast Kentucky that fit the scenario in the petition but the involvement of horse suggests a cavalry unit. The Major Treadway mentioned in the petition is certainly Elisha B. Treadway who entered the 7th Kentucky Infantry as a Captain and mustered out as a Major.
