pg 74 Will of David A Rice

In the name of God. Amen: I, David A Rice, of the County of Harlan and State of Kentucky, do hereby make, publish and declares, this my last will and Testament, hereby revoking any and all wills by me heretofore made.

First I direct my executors hereinafter named to pay my funeral expenses and all my just debts and liabilities as soon as can conveniently be done after my decease.
SecondI give and bequeath to my son J. B. Rice, all of a certain tract or parcel of land described as follows, towit: Being and lying on the little field hollow waters of Pucketts Creek of Cumberland River, in the County of Harlan State of Kentucky; and bounded as follows towit: Beginning on a sugartree standing on the West bank of the branch of the little field hollow; Thence somewhat West on a marked line, to the top of the mountain; Thence with the top of the mountain to the middle stream of the little field hollow; Thence down said stream to the beginning. Said tract of land now given to him in possession
ThirdI give to my daughter Sarah J Owens, a certain tract or parcel of land being on the same waters and in the same county and state as aforesaid and joining the land given and bequeathed to my son J. B. Rice above and bounded as follows, to-witt: Beginning on a sugartree a corner of J. B. Rice and Thence running with the said line of J. B. Rice to the top of a ridge; Thence with the top of the ridge to the next marked line; Thence with said marked line to the branch Thence up the branch to the beginning.
FourthI will and bequeath to my son Wm Robert Rice, a certain tract of or parcel of land being on the same waters and in the same county and State as aforesaid and joining the land above that I have given my daughter Sarah J Owens bounded as follows, towit: Beginning at the branch on the corner of Sarah J Owens; Thence with her line to the top of the ridge; Thence with the top of the ridge to a marked line; Thence with the marked line down to near a sulpher spring; Thence with another marked line running around the said ridge with a marked line to a hollow; Thence down the hollow to the branch; Thence with the branch to the beginning.
FifthI give to my son Thomas H. Rice all of a certain tract or parcel of land being and lying on the same waters and in the same county and State as aforesaid and bounded as follows: Beginning on the branch and running up with a marked line
page 75to a sulpher spring; Thence around the ridge with a marked line to a hollow; Thence down the hollow to the branch; Thence with the branch to the beginning.
SixthI give devise and bequeath to my wife Elizah Jane all of a certain tract or parcel of land being and lying on the same waters and in the same county and State as aforesaid, and bounded as follows towit: Beginning on the branch and running up the mountain with a marked line of Thomas H Rice and Wm R Rice to the top of the mountain; Thence with the top of the mountain to the next marked line; Thence with said marked line down the mountain to the branch; Thence with the branch; Thence with the branch to the beginning.
SeventhAll the rest, residue and remainder of my estate, real and personal. Wheresoever situate of which I may die seized and possessed or in anywise entitled to not herein before effectually disposed of; I give devise and bequeath to my daughter Linda E Rice, her heirs, executors, administrators and assig as forever.
EighthI hereby nominate, constitute and appoint my said sons Wm R Rice and T H Rice, executors of this my last will and testament.
In witness whereof. I have hereunto subscribed my name and affirmed my seal. This twenty-second day of March in the year of our Lord, One Thousand Eight Hundred and Ninety three.

I David A Rice, of the County of Harlan and State of Kentucky do hereby make and publish this codicil to my last will and testament hereto amend bearing Date, the twenty-second day of March AD 1893 in manner following towit:
FirstI hereby revoke the bequest of a tract of land to my son Thomas H Rice in the fifth clause or article of my said will and in lieu thereof give and bequest to him a certain tract or parcel of land being and lying etc., on the little field hollow water of Pucketts Creek of Cumberland River in Harlan County, Ky and bounded as follows, towit: Beginning on the branch and up with a marked line to a chestnut standing in the (can't make out word)
page 76Of the ridge; Thence running around the ridge passing a sulpher spring to a crib, Thence down that hollow to the branch Thence with the branch to the beginning.
SecondI hereby revoke the bequest of a certain tract or parcel of land to my wife Eliza J Rice contained in the Sixth clause or article of my said will and in lieu Thereof give and bequeath to her all estate above, as bequeath to my daughter Linda E Rice as contained in the Seventh clause or article of my said will.
ThirdI hereby revoke the bequest of my estate real and personal to to my Daughter Linda E Rice as contained in the Seventh clause or article of my said will and in lieu there of give and bequeath to her a certain tract of parcel of land described in the Sixth clause of my said will which I bequeathed to my wife Eliza J Rice hereby ratifying and confirming my asaid will in all other respects I declare this to be a codicils to my said last will and testament. In witness whereof I have hereunto subscribed my name and affirmed my seal this 1st day of May AD 1893
