John & Jane Lee Fee©
[son of David & Lucy Noe Fee]
John Fee(1), son of David and Lucy NOE FEE, was born in February of 1816 in that part of Knox County which was to become Harlan just three years later in 1819. On 23 August 1838 in Harlan County(2), he married Jane `Jenny' Lee, born about 1820, daughter of Stephen and Joicy Napier Lee. Jane died in the 1870's per the Lee vs Lee case(3). John died about 1911 reputedly "of injuries received when he was thrown by a horse". He is buried in the Old Dave Fee Cemetery on Slators Fork. Although some tradition states he served for the Union in the Civil War, no evidence supporting actual military service has yet been located. He may simply have been an active Union supporter.
John Fee obtained several land grants in Harlan County in the
1840's:
- 200 acres 11 July 1842 Martins Fork
- 4000 acres 20 Aug 1845 Martins Fork
- 400 acres 25 Feb 1845 Open Hollow Waters
- 200 acres 28 Sep 1849 Slaters & Catrons Creek
John and Jane Lee Fee had nine known children(4):
- Henderson Fee md Sarah Osborne
- David Fee md Viney Ledford
- Hiram Fee md three times
- George Fee md Margaret
- Manerva Fee md James T Middleton
- Delia Fee
- John Fee md Sarah & Elizabeth Green, sisters
- Amanda Fee md her cousin Abner Fee
- Mary Fee md James Washington Osborne
- Henderson Fee born 20 June 1839 Slators Creek died 1918 married 21 Apr 1861 Harlan to Sarah Osborne 5-2059 [1845-1916] daughter
of Enoch and Malinda Farmer Osborne. Henderson and Sarah had no children. At the beginning of the Civil War, in October of 1863, Henderson enlisted in Company H of the 47th Kentucky Volunteer Mounted Infantry for a term of one year. He and his brother David deserted from the unit at Camp Nelson on 27 January 1864.
- David Fee born Oct 1840 Harlan married ca 1867(5) Lavina `Viney' Ledford born Feb 1851 5-2315 daughter of James & Mary Farley Ledford. At the beginning of the Civil War, in October of 1863, David enlisted in Company H of the 47th Kentucky Volunteer Mounted Infantry for a term of one year. He and his brother Henderson deserted from the unit at Camp Nelson on 27 January 1864.
David & Viney moved to Leslie County sometime between the
1880 census when they were still in Harlan County and the 1900 census when they are listed in the Bad Creek District of Leslie County where they died and are buried.
[Have their son John's JJDickey interview] Viney is listed in the 1900 census as having had 12 children, all of them still living. She died between the 1900 and 1910 census as David is listed as a widower in 1910 when Loyd, William, Amanda, Ewell and Bradley are still living at home.
Ewell Fee said of his father "He used to make shoes with rawhide and wooden pegs. People bought them from him - his only way of making cash. He was never one to go away from home to work. he made wooden things to cut wheat too. They used to raise wheat down home in little patches."
- James L FEE born ca 1868 is said to have been an educated man
with pretty handwriting; an expert marksman and trader and that he could beat almost anyone target shooting with either a rifle or a pistol.
MARRIAGES MIXED UP !!! His first marriage (his residence at this time is listed as Harlan County) was 17 Dec 1889 to Mary Jane HOWARD born ca 1882 in Perry or Clay County. (bond on this was by Lee
Howard) They divorced and she married #2, in June of 1894, to Thomas COLLINS. Second marriage was probably in Clay County to Lucy ROBINSON born May 1876 who later, ca 1900, married James HACKER.
His third marriage was to Laura FARLEY born November 1873
James married (for the fourth time?) on 26 October 1906 in Lee County, Virginia(6) to Mary SCHOOLCRAFT, born October 1889 in Clay County, daughter of
Madison and Catherine SCHOOLCRAFT. James' occupation at this marriage is listed as "book agent"-not located in 1900, may be in Harlan County or in Lee County VA - said to have killed a man in Lee
County VA, may be in Virginia penitentiary??? - his son Charley FEE by his ???first marriage is listed as a stepson in James HACKER's household in Clay County. In 1928, Mary is listed at Tway with her children in the school census. She married secondly to W J ASHER at Elcomb on 15 Mar 1930.
James was shot and killed at Yancey on the head of Catrons Creek in Harlan County 18 August 1926 and is buried in the Fee Graveyard at the head of Slators Fork - see HDE article.
James was charged in 1924 as an accomplice in a 27 year old murder. The news article which appeared at the time states that: "James Fee, deputy officer at Yancey, was charged as accomplice in murder that happened 27 years ago. His brothers Hiram and Joe
received 21 years & 2 years respectively in the pen for killing Joe Asher by knife cuts." This killing thus took place about 1897 and James' brother Hiram did spend time in the penitentiary as he is listed there in the 1900 census. A news mention at the time gives the victim's name as Bob Asher. There is no evidence to support the third brother, either he was not a brother, his name was other than Joe or he was born after 1880 and left no trace by 1900.
Harlan Daily Enterprise, Friday, August 20, 1926:
SHOTGUN USED TO KILL DEPUTY
Jim Fee is Murdered From Ambush
At His Home near Yancey Tuesday Night
Jim Fee, 68, deputy sheriff was assassinated Tuesday night as he stood on the porch of his home at Yancey. His murderer stood in a small plot of corn near the house and shot the deputy sheriff twice with a shotgun. Jack Stephens was arrested Wednesday morning at his
home, 2 miles from the scene... Mr. Fee had arrested Stephens Tuesday morning on the charge of selling liquor and had given bond
for (Stephen's) appearance. Stephens went back to his home and is supposed to have threatened Fee. About 8:30 Fee walked out on
his porch... he lived until 2 AM and accused Stephens of the murder before he died... Mr. Fee had been a deputy sheriff in his community
