Will of Benedict Hammock of Jones County, Georgia
This document was transcribed from a copy of what appears to be the ORIGINAL Will, not the recorded court document. (The hand writing is different from the court entry and each of the signatures appeas to be in a different hannd.) The document shows the name to be written with the Hammock" spelling. This should not be taken as proof one way or the other on the spelling of the name, since he could not hear, speak, read or write, but communicated by signs. He apparantly must have been able to communicate quite well with those close to him. He of course, did not write the document and signed by his mark which was "+" rather than "x".
My copy of this supplied by Barbara Lockard.
In the name of God Amen. I Benadict Hammock of Jones county in the State of Georgia, being in health of Body and Sound Mind, Memory and understanding, but deprived of two of the greatest Bessings that man can possibly Enjoy, from my birth. That is Of hearing and Speaking, but through the Same goodness Of Providence can understand perfectly by signs, how to trade & transact my business, and which Signs, I am perfectly Satisfied that the witnesses to this my last will understand, & know how to Converse with me, as they have been in the Habits of doing, So frequently.
Do make this my last will & testament, in manner & form following.. I give and bequeth unto my beloved wife Sally Hammock, All my money, Securities for money, Goods, Chattles, Estate & Effects, Lands & Negroes, and also of what nature or kind Soever that I am posessed Of at my Demise, after my Just debts are paid. She having behaved herself as a faithful, industrious & good wife, since our marriage.. To have and to hold the same lents?? my said wife, her Executators administrators & assigns forever to dispose Of them, as she may think forever, & I do Nominate & appoint my said wife, my Sole Executrix of this my last will & testament hereby revoking & making void all former wills made by me. And having been informed that wills are frequently attempted to be disputed & made null & void. I do request that no such thing may be attempted with this , as I have had time to deliberate before I sign & seal this my last will and Testament..--
