LINCOLN CO., GA WILL BOOK D P.250-252. WILL OF JOHN HAMMOCK SR. Dated DECEMBER 29, 1829.

GEORGIA. LINCOLN COUNTY. In the name of God Amen. I, JOHN HAMOCK SENIOR of the State and County aforsaid being advanced in life and infirm in body but in my right mind and senses and memory do make nominate and ordain this my last Will and Testament in the maner and form folowing viz:

First. I commit my soul to God that gave it through the merits of Jesus Christ my Redeemer

Secondly. I commit my body to the earth to be buried desently at the discretian of my surviving friends and it is my will and I do hereby will and bequeath that all my just debts be discharged out of my Estate and that my land whereon I now live to wit - four hundred and seventy five acres in Lincoln County also two hundred acres Wilkes County whereon my son DAVID HAMOCK now lives to be sold at public sale to the highest bidder at two years credit and that all my personal estate be sold at one years credit and the money when collected to be distributed as follows and first I will and bequeath to my grandchildren the heirs of my son SAMUEL HAMOCK dec'd to wit: THOMAS B. HAMOCK, JOHN B. HAMOCK & SUSANNAH STRINGFIELD one dollar each besides the property already given to their father.

Secondly I will and bequeath to my beloved son WILLIAM HAMOCK SENIOR two dollars besides the property allready given to him

Thirdly I will and bequeath to my grandchildren the hiers of my son JOHN HAMOCK JR to wit: WILLIAM G. HAMOCK, JEREMIAH HAMOCK, JOHN G. HAMOCK, SIMEON HAMOCK & ELIZA MONCRIEF one dollar each besides the property allready given to their Father.

Fourthly. I will and bequeath to my son ELIJAH HAMOCK two dollars besides the property allready given to him.

Fifhly I will and bequeath to my daughter FEREBY MUMFORD and the heirs of her body five hundred dollars.

Sixthly I will and bequeath to my son PASCHALL HAMOCK two hundred dollars besides the property already given to him.

Seventhly. I will and bequeath to my daughter ELIZABETH ROLING and the heirs of her body five hundred dollars.

Eightly I will and bequeath to my son CHARLES HAMOCK two hundred dollars besides the property already given to him.

Ninethly I will and bequeath to my daughter MARGARET GREEN and the heirs of her body five hundred dollars.

Tenthly. I will and bequeath to my daughter RELIANCE STEDHAM and the heirs of her body two hundred dollars besides the property allready given to her.

Eleventh. I will and bequeath to my son THOMAS HAMOCK five hundred dollars.

Twelthly. I will and bequeath to my son DAVID HAMOCK five hundred dollars and if any money remains in the hands of my executors to be equally divided among all my surviving heirs.

Thirteenthly and lastly I ordain and appoint JOHN H. WALKER, WILLIAM PASCHALL & WILLIAM MONCRIEF Executors of this my last will and testament to bring the same in effect.

This indenture made and entered into this the 10th day of June in the year of our Lord one thousand eight hundred and eighty-five (1885) between James J. Hammack and his wife, Amanda F. Hammack and Wallace M. Hammack and his wife, Maggie S. Hammack of the County and State aforesaid parties of the first part, and Robert A. Lankford of the County of DeKalb and State of Alabama party of the second part.witnesseth that the parties of the first part, for and in consideration of the following to wit:

That whereas our Father, Willoughby Hammack, and our mother, Nancy A. Hammack both of whom are resident citizens of the said County of DeKalb and State of Alabama, and whereas our said Father and Mother, are far advanced in age and by reason of such, have become feeble and decrepit, and in consequence thereof are unable to support and provide for themselves, the necessary comforts of life, and whereas our said Father and Mother (to wit Willoughby and Nancy A. Hammack) occupy and reside upon a tract of land situated about one mile..., which is the land deeded by Luvicey Garrett and her husband, James Garrett to Mary Elizabeth Hammack, her brothers and sisters, which is fully described in said deed made by said Luvicey Garrett and her husband, James Garrett on the 13th day of September 1843...which land is the same land occupied by the said Willoughby Hammack and Nancy Hammack our said Father and Mother, and we being the heirs of the said Willoughby and Nancy Hammack and mentioned and alluded to in said deed of Luvicey and James Garrett as the brothers of Mary Elizabeth Hammack the said Mary Elizabeth Hammack being one of our sisters.

It goes on to mention that Robert A. Lankford is their nephew and the son of their deceased sister, Sarah A. Lankford and it is signed by James J., Amanda F., Wallace M., and Maggie S. Hammack.

The next part is a document signed by a notary in Texas.

Then the next part is a document similar to the first one, but written in DeKalb County, Alabama on 13 August 1885, between John F. Thomason and his wife Mary Elizabeth Thomason (formerly Hammack), Eliza E. Griffith, Jefferson D. Lankford and his wife, Valenia Ellen Lankford, Milford W. Howard and his wife, S. A. Howard parties of the first part and Robert A. Lankford, part of the second part of ... being the children and grandchildren....


NOTE by Tom Hammack, Jr.:
The Col Milford W. Howard mentioned above was written about in a book, The Vagabond Dreamer, by Elizabeth S. Howard.

He was well known in DeKalb County, Alabama and established a church on Lookout Mountain. This unique church has one wall, I believe that it is where the altar is located, which is a huge boulder that was on the site.


Another document was a single page that appears to be a bond for Jesse Will who was elected Justice of the Peace. The document is signed and sealed by Jesse Will, Thomas Hammack and Oates P. Bryan and dated 3 October 1839. Ring any bells?

WARREN COUNTY

G.H. HAMMOCK of said State and County beinf of sound and disposing mind and memory do make this my last will and testament.

ITEM FIRST. I give, bequeath and devise to my son BENJIMAN HAMMOCK his natural life and then to his legal heirs the following property to wit, the lot he lives on bounded on the east of lost of MRS. W.H. JOHNSON on south by fence of my gardon on west by fence between said lot and my shop lot and on north by GEORGIA RAIL ROAD or publick road.

ITEM SECOND. I give bequeath and divise to my son A.S. HAMMOCK his natural life time the following property to wit: the lot known as my shop log and my shop tools and buildings as his on property in fee.

ITEM THIRD. I give bequeath and devise to my son A.S. HAMMOCK and my daughter MISS N.A. HAMMOCK all the remainder of my land their natural life time and then to their children either or both as such be the case.

ITEM FOURTH. I give bequeath and devise to my son A.S. HAMMOCK my pistol, testament and Fiddle. (*under Fiddle is written bittle) I also give bequeath to my grandson GEORGE HAMMOCK my other bittle and to my grandson J.O. HAMMOCK my watch and chain and to my grandson J.A. COPPUCK? the sum of two dollars and to my grandson WM. A. HAMMOCK the sum of two dollars to be paid by my son A.S. HAMMOCK and the remainder of my household and kitchen furniture. I give bequeath and devise to my daughter N.A. HAMMOCK as her own property in fee. I make this my will and testament because my son A.S. HAMMOCK and my daughter N.A. HAMMOCK has nurced and provided for me and their mother in her life time more than all my other childred an grandchildren to gether. So I make this my will and testament as a reward for their services.

ITEM FIFTH. I hereby constitute and appoint my friend JAMES A. SCRUGGS Executor of this my last will and testament this 19TH DAY OF APRIL 1889.

Hammack Cemetery

Fort Payne, Alabama

On April 4, 1997, I listed all identifiable graves in the cemetery. The information collected is listed below.

The cemetery is located at the bottom of the slope of Lookout Mountain near the South end of Fort Payne. It is adjacent to , and just across the Southern Railroad from the land currently owned by the Hammack family. I believe that this land was a part of the original land grants purchased by the Hammacks in the mid 1800s.

It should be noted that there are several unmarked graves. I know the identity of one of them from information given to me by my father. I would like to know the names that go with the other graves. Please let me know if you can identify any of them.

Note: My father, Thomas Hammack, Sr. indicated that the stone was engraved with the wrong spelling, but the stone cutters would not correct it. The family always used Hammack. Documents with Willoughby's signature had Hammack.

Per Alma in California 31 per Alma 29 stone a child 30 child 2 spots at 28. There were 2 rocks there. The space is still there/ She believes that Francis Lyons and wife Mary Margaret Lyons Hightower are there. Uncle Maston sisters: 1 lives close Mt. Moriah on Sand Mountain. Another in Alexander City. Only one of Maston's boy Cornelia dau of Francis names for Smart. William Samuel A. Lyons m L. Nancy (Luvicy) Hammack daughter of Willoughby. Glenda Lyons Tidwell, published family group records that William was wounded in Civil War by a ball that went through his horse and knocked off a leg.
