These items were copied as found in the Archives of Cheatham County and are not in specific order by date. Be aware that the difficulties of interpreting the handwriting of the loose papers coupled with the sad state of the papers themselves, plus my own inadequacies with spelling and knowledge of names of the era may tend to render these utterings as incorrect in many respects.

Your indulgence and willingness to accept these as I have prepared them is necessary. If you find an obvious error you might advise me and I will review it and make necessary changes if appropriate. I have not seen an attempt at this type publication that did not have errors. Be Fair.

Additionally, it should be noted that some of the items found here were apparently misfiled in with the 1856 loose papers and have not yet been placed in their proper files. I entered them anyway rather than attempt a complete overhaul of the filing system.

If an entry for a name or word appears in italics then it is due my inability to make out the name or word from the handwriting and have given it my best effort.

SPECIAL NOTE: I am of the opinion that very often the term which appears to be "hands"may infact be interpeted as "lands" and vice versa.Additionally; bear in mind that my left little finger and left ring finger no longer function properly ‘a product of maturity’ and you may find many places where the letter ‘a’ is missing; that is my fault - put one in there and read on.

I did not attempt to Spell Check this document due to its length and the many, many names herein.

Item 01. State of Tennessee Cheatham County Court June Term 1856. The court ordered that T. OBrian, S. Perry, J. M. Gent, J. L. Harris, A. B. Gibbs, A. B. Carney, James Lenox and J. L. Sexton be appointed a Jury of View to view and lay out a road of the Second Class from the ford of Spring Creek near Eagle Mills to the County Seat of Cheatham County and that the Sheriff of said county summon the said Jurors of View to meet at the beginning of said road, on an early day, and view and lay out said Road according to law and make report of their proceedings to the next term of this county. Item 02. Cheatham County Court July term 1856. It is ordered by the court that Thomas O’Brian oversee the road leading from or near the mouth of Spring Creek. Beginning at the ford of Spring Creek, and work the same to the county Seat of said county and with the following hands to work. A. J. Carney, all the hands at Eli Brinkleys place, all the hands t Sawyers place, and all the hands that worked under the last overseer. Keep the same in repair according to law. Item 13. State of Tennessee Cheatham County July term 1856. It is ordered by the court, that Nathan Morris, J. J. Nilson, David H. Felts, G. W. Shaw, Latton Watson, and Dempsey Hunter b appointed a Jurey of View to view and lay out a road of the Second Class from the ford of Racoon Creek near H. Hunters Store to the County Line of Cheatham County near Doc A. D. Cages the most practicable rout and that the Sheriff of said County summon said Jurors of view to meet at an early day at the beginning of said road and view and lay out the same and report your proceeding to the next term of this court. Item 14. Cheatham County Court August term 1856. It is ordered by the Court that Henry Maxey oversee the road leading from Sycamore Mills to Cheap Hill, to work said road from Spring Creek to the Old Weakleys Ferry Road and that he with the following hands to wit, Jack L. Krantz, J. L. Edwards, W. D. Wall, Rawls Maxey, A. Edwards, G. W. Edwards, Wash Wall, Ben Smith, E. Smith, Elijah Smith, B. F. Steward, James M. Gent, John Sanders, David Sanders, Hiram Sanders, A. Item 15. Report of Jury of View from Spring Creek near Eagle Mills to the town of Ashland. Beginning at the ford of Spring Creek thence edging the hill by marked trees to the east of Spring Creek to where Sycamore leaves the bluff thence crossing the creek into the present road near W. W. Davis turning through his farm leaving his apple orchard on the west side of the road, thence on the top of the ridge through Nancy Simmons farm and continuing through her wheat field thence with the Old Road to the lower steep part of Marks Creek Hill, thence running down the steep part twenty feet east of the old road, and thence with the present road to the County Seat. Item 16. State of Tennessee Cheatham County Court June term 1856. It is ordered by the Court that G. W. Shelton, L. Hooper, W. P. P. C. Bryan, R. Gibbs, F. Balthrop, B. Gibbs, S. Morris and M. F. Hale be appointed a Jury of View to view and lay out a road of the 2nd class from the bank of the Cumberland River opposite the County Seat of Cheatham County, to William Shearons placeon Brush Creek and that the Sheriff of said county summon the said Jurors of View to meet at the beginning of said road at an early day and view and lay out said road according to law and report their proceedings to the next term of this court. Item 18. To theHonorable County Court of Cheatham County. We the undersigned citizens of

Cheatham County for the Benefit of the public do hereby petition and sincerely pray to your honorable body to grant us a Public Road Leading from Ashland to Modeleys Ferry and thence to the county line of Cheatham County by the most practible route that can be viewed out by the commissioners that may be appointed by your honorable body. Item 20. Cheatham County Court, July term 1856. It is ordered by the court that Charles Vedder oversee the road from the ford of Sycamore Creek near Sycamore Mills to the town of Ashland, and with the following hands, to wit, all the hands at Sycamore Mills, also the hands at

Item 21. Hands & overseer assigned the following roads in the 9th District Cheatham County. Item 22. It is ordered by the court that James J. Wilson oversee the road from the Woolf Den Branch to the Nashville Road at the Sarah Shaw’s and that they with the following hands /lands Viz: - J. J. Wilson’s hands, Robert Pennington hands, Jas Rosson, Lafayette Williams J. B. Langdons, Z. Owens, J. E. Turnor, and David Bracy and keep the same in repair according to the 2nd class of roads. Item 23. Letter - Nashville, June 25 1856. Dear Sir, By the acts of 1794, Chapter 1 paragraph 72 and 1805, Chapter 1 paragraph 1, it is made the duty of the clerks of the county and circuit courts, by themselves or lawfully appointed deputies, to keep their offices within the county town, or at the places established by law for holding the courts; and thereby themselves or deputies, to give attendance for the purpose of performing their official duties.

By the act of assembly establishing your county, Sycamore Mills is made the place of holding the courts; but the county court is vested with "full power to adjourn to such other place in said county, as they may deem better suited for the holding of the same, and for the public convenience."

When the county court adjourns from Sycamore Mills to some other place, that place is the place established by law for holding the courts, and the clerk’s office must follow the court, and be held and kept where the court is held. Item 24. We the undersigned jurors appointed by the county court of Cheatham County,, June term 1856 met pursuant to order of court, viewed and layed out the road assigned us, beginning on the bank of Cumberland river opposite the county seat, running up said river between Sidneys Bluff nd the river crossing Bluff branch at the mouth, thence along the bank of the river to near the mouth of the next branch thence oblique to the points of the ridge crossing the branch and running on the side of the hill above high water mark crossing the next branch where the old road crosses thence with or near the old rod to the end near Wm. Shearons. We believe there can be a 2nd class road built on this route with considerable costs. The portion between the bluff and river is the most difficult part, the balance is over fair grounds. There will be a bridge to buil across Bluff branch about 150 ft long. Viewed and played out the above road this 28th June 1856. Signed: ? Balthrop, B. H. Gibbs, R. B. Gibbs, W.G. Item 25. Report to change a portion of the Nashville and Clarksville Road between Sycamore Creek and J. J. Hoopers. To the worshipful county court of Cheatham County in compliance with an order directed from your June term appointing a jury of View we beg leave to report that after being summoned and duly sworn, we have passed upon that portion of the rod proposed to be changed andd that we think in our judgement that it will not inconvenience the traveling community to make a change, or so vary from the present Old Road, Beginning at the top of the Hill on the west side of Sycamore Creek thence bearing South thence West, so as to intersect the old road again near Wm. Felts’ the whole distance supposed to be not more than fifty yards further, so as to leave the cleared lan of Said Felts and James Hams in one body, we think the change should be made and we do make the same, all of which is respectfully submitted this 14th dasy of June 1856. Item 26. Being is a true copy of the report of the Jury of View, to lay out road of the first class from Sycamore Creek near Sycmore Mills to Ashland.

Report, Commencing at the ford of Sycamore Creek, and continued on the rout of the Sycamore and Nashville Turn Pike, to the fork of James Lenox’s Road and continued with said Lenox’s Road to the fork of A. Item 27. We the Jury of View duly sworn to service and lay out the road from the ford of Spring Creek to the fort of raccoon at Dempsey Hunters’, running up the old road from Spring Creek starting at same place up to where Benjamin Smith’s path leaves the road or near to Robert Sander’s line and thence with said line to A. J. Teasley’s big gate thence west to A. J. Teasley’s

cornfield thence threw said cornfield into the pasture thence down the hollow near their to A. J.

Teasley’s other big gate. Thence north to Jesse Shearon’s to his fence at the Springfield Road thence running up his Spring branch in the west side up to his lane at the head of the hollow. Thence with the line to the mouth, thence running North with said line to Jesse Sheron’s hog pen. Thence running to William Walker’s straw stack, thence running nearly sterait to the mouth of the lane between E. H. Nicholson and Jo Woodsons thence with with the old road to racoon creek. Item 28. Know all men by these presents, that we Cheatham Watson & Co. are held and firmly bound to the State of Tennessee in the final sum of One Thousand dollars to which payment will and truly to be made we bind ourselves and each and every one of our heirs and representatives, severally and jointly sealed with our seals and dated the 5th day of November 1856. The condition of the above bond is such that wereas the said Cheatham Watson & Co is about to obtain a license to retail goods and merchandise in the county of Cheatham the ensuing twelve months. Now if the said Cheatham Watson & Co. shall render to the clerk of the county court for the county of Cheatham at the end of twelve months from the date of this bond Statements of the invoice cost of all the goods which they or their assignee shall bring to their establishment for sale within the said twelve months and they will pay the said clerk the tax upon such goods then this obligation to be void. Otherwise to be and remain in full force and virtue.
