Last Will and Testament of Andrew O'Neal

The State of Alabama, DeKalb County, September the 7th A.D. 1856.

The last will and testament of Andrew O'Neal of the County and State aforesaid.

   I, Andrew O'Neal, considering the uncertainty of this mortal life and being of sound mind and memory do make and publish this my last will and testament in manner and form following, that is to say I give and devise to my Son, Edward W. O'Neal, his heirs and assigns, the east of the south half of the north east quarter oof section thirty in township 5 range 10 .

   I give and devise to my Son, Zachariah O'Neal, his heirs and assigns, the south east quarter of the south east quarter of section twenty five of township 5 and range 9.

   I give and devise to my Son, Briton B. O'Neal, his heirs and assigns, the west fourth of the south half of the north east quarter of the south half of the north east quarter of section thirty of township three and range ten.

   I give and bequeath to my Son, Phillip S. O'Neal, one sorrel bald faced horse colt, one cow and one yearling, five head of hogs.

   I give and bequeath to my daughter, Hamer Wilson, three cows and young calves M---- hart and black as a balance of her portion with what she previously has given to her.

   I give and bequeath to my daughter, Nancy O'Neal, two dollars and fifty cents.

   I give and bequeath to my beloved wife Ann Smith O'Neal, the west half of the southeast quarter of section nineteen in Township three and range ten. I give and bequeath to her one sorrel mare, one man's saddle, one rifle and shot pouch. I also give all the balance of my stock that has not been portioned off and mentioned above, cattle, hogs, sheep, geese and bee stands that is now in my possession, also my interest in a stock (?) of hogs that is in the possession of my son Edward W. O'Neal at this time, also a sow and yearling that is in the possession of my son Zachariah O'Neal at this time.

   I also give and bequeath to her all my interest in the present crop including corn, wheat, oats, and all household and kitchen furniture, all the farming tools and tools of all kinds. It is my wish and will that the tract or parcel of land known as the north west quarter of the north east quarter of section twenty two and township three and range ten be sold and the proceeds together with all the debts due me by notes and accounts also all my interest in a grocer store kept at Trenton by Zachariah O'Neal's son be collected out of the above proceeds.

   It is my wish and will that all my just debts and funeral expenses be paid off out of any of the above income and the remainder to be collected and paid over to my beloved wife aforesaid.

   All of the above items mentioned, I give and devise and bequeath to her for to keep and hold during her natural life and widowhood to raise her children and to dispose of as she thinks best and then all that remains to belong to her children including Augustus F. O'Neal and all younger equal shares.

   I, furthermore and lastly, hereby appoint Edward W. O'Neal and D. B. Burkhalter my sole executors of this, my last will and testament, hereby revoking all former willsby me made in witness. I set my hand and seal.

The above and within consisting of one sheet was now here subscribed by Andrew O'Neal the testator inthe presence of each of us and at the same time declared by him his last will and testament and we at his request sign our names hereto as attesting witnesses.
