MINERAL LEASE

THIS AGREEMENT, made and entered into this 2nd day of May

A.D. 1932 by and between Alfred Brantley and wife Adline

Brantley and Dr Henderson Longmire of 5th Civil District

county of Union of Tennessee, of the first part, and W, H. Ford

and C. A. Harris of Kingsport, Sullivan County, Tennessee, of

the second part.


Witness, That the party of the first part, in consideration

of (One) ($l~00) Dollar, in hand paid, the receipt of which is

hereby acknowledged, have granted, leased, devised unto party

of the second part, his principal heirs and assigns, until all

minerals or ores shall have been mined therefrom, the sole and

exclusive right to mine all ores minerals on that certain tract

of land situated, lying and being in the 5th Civil District of

Union county, Tennessee, containing 25 acres, more or less of

land bounded in general terms as follows:


On the north by the lands of G~ T Sweat, on the east by the

lands of Alfred Brantley, the south by the lands of Jim Smith,

on the west by the lands of Riley Lambert, said first parties

hereby grants full mining right and privileges to said second

party and his assigns, including all necessary rights-of-way

for railway switches, tramways and pipes, with full mining

rights and all other privileges which may be necessary for the

mining, delivery and shipment of said ores therefrom and ores

from adjacent and by lands, mined by said lessee or his assigns

in all of said operations


Said second party, his principals, heirs or assigns shall

have and hold said premises for such mining purposes only, and

shall pay unto said first parties, as heretofore provided

royalty for fifty (50) cents per ton on Barybes, twenty-five

(25) cents per ton on iron ore, (50) cents per ton on Nangenese

ore, fifty (50) cents per ton on any kind Calamine or Carbonate

or Zinc, fifty (50) cents per ton on Kaolin (china Clay) (5)

per cent per ton on any kind Lead, Zinc or Copper. And a

royalty of ten percent (10) gross selling price any and all

other minerals of any kind or description mined from the above

described premises, and said second party, or his assigns, as

by covenants and agrees to pay the said lessor said rent or

royalty for all ores or minerals mined and sold, or shipped

from said leased premises on or before fifteenth day of

January, April, July and October, respectively, during the

continuance of this lease, all the rents and royalties accrued

for ore mined and shipped from the leased premises by the

lessee during the preceding quarter of three (3) months:

Provided that should said lessee fail to mine a sufficient

amount Cf ore within any calender year to pay as royalties at

least ten (bc) cents per acre per annum, he shall pay said sum

as liquidated rent or royalty, failing which for thirty (30)

days after the expiration of said 24 (twenty four) months said

lease shall be cancelled (ipse dixit) by said lessee but such

royalties, if so advanced, shall be credited to the lessee upon

further royalties in excess of such minimum


The lessee further canvenants and agrees to plan, operate

and conduct the ore-mining operations on the leased premises,

at all times, in a skillful judicious and workmanlike manner


On the expiration of this lease, all machinery, apparatus,

tramways, tracts, chutes, rails, inclines, houses, buildings,

working tools and implements used in mining and all horses,

mules, cars, engines, boilers, pumps, winding drums and rope of

wire or cordage used therewith, and weighing scales placed upon



said premises by the lessee, shall be on the property of the

lessee and may be removed, provided the right of removal is

exercised within six (6) months after expiration of this

lease.


In witness whereof, the said parties of the first part and

second part have duly executed this instrument the day and year

first above written

Personally appeared before me V, H. Graves a Notary Public

for and within said county and State, the within named

bargainers Alfred Brantley and wife Adline Brantley and W. H.

Ford and C. A. Harris with whom I am personally acquainted, and

who acknowledged that they executed the within instrument for

the purposes therein contained and expressed9
