Will of Thomas E. Everett

I, Thomas E. Everett a citizen of the first Civil district of Wilson county and State of Tennessee of sound mind and desposing, do make and publish this as my last will and testament revoking all other wills heretofore made by me.

Item 1. My will is that my personal expense together with all my just debts be paid as soon after my death as convenient.

Item 2. I will to my son N. C. Everett whatsoever balance may be at my death on a note I now hold against him given July 1st 1892 for about seventy six dollars and secured to me by deed in trust.

Item 3. I will to my son Thomas H Everett a one-fifth interest in the farm I now own in Neeleys Bend containing about one hundred and thirty acres.

Item 4. I will my son James L. Everett a one fifth interest in said Neeley Bend farm.

Item 5. I will to my son Jesse Everett a one-fifth in said Neeleys Bend farm.

Item 6. I will to the four children of my son N.C. Everett by his first wife Mattie Everett viz: Burkette F. Everett, Althea Everett, Nickie Everett and Eveline Everett one-fifth.

Item 7 I will the remaining one fifth interest in said Neeleys Bend tract shall go to pay those or that person a reasonable compensation for taking care of me in my declining days, and whatever may be left after this amount is paid I desire be divided as follows. Thomas H. Everett one fifth, James L. Everett one fifth, Jesse Everett one fifth and the remaining two fifths to the four children of my son N.C. Everett named above.

Item 8 I direct that my Executors shall divide or cause to be divided the above mentioned farm into five parts equal in value, or shall cause said farm to be sold for division as a majority of said adults legatees may elect and I hereby five my Executor expires power to sell the same without the intervention of any court of Courts, it being my will that the sum divided with as little expense as possible. The one fifth interest above charged with the expense of my maintenance above set out in case a division is made by my Executors of the land shall be sold by my Executors and with the proceeds shall pay to the person or persons causing the same the reasonable ampersation above mentioned and the remainder divided as set out in Item 7.

Item 9 I will to my son C. C. Everett the farm on which he now resides containing about one hundred and thirty acres it being my old home place with this reservation :viz: I reserve one half acre to be laid of as follows: Beginning at the South-west corner of the garden run eastwardly with garden fence for enough to enclose all the graves now on the same and thence South for conslements together with right of way at all times the same, forever. The adult legatees under this will are hereby charged with the duty of laying out this graveyard which I desire to be done as soon as possible and to make certain the performance of said duty. I desire that my Executor shall rent out my farm in Neeleys Bend until this duty shall be fully performed.
I give also to my son C. C. Everett my one half interest in mower and hay rake and the bequest contained in this item shall be in full of all claims in my estate to said C. C. Everett.

Item 10 I direct that my executor shall take charge of all the personal property of which I may die possessing and divide the same among the legatees except C.C. Everett or sell the same and divide the proceeds as they may elect.

Item 11 I nominate my sons Thomas H. Everett, Jesse Everett and C.C. Everett as my executors.

Item 12 In conclusion, I will that should any legatee or legatees under this will seek to destest the provisions that he or they be deprived altogether of the benefits of the same.
