WATTERSON of said County and State, known to me to be a credible person and who being by me duly sworn upon oath states: That I was acquainted with J.L. FREEMAN who resided in Bastrop County, Texas, and on information states that J.L. FREEMAN's first wife died before or during the Civil War, and left surviving the following named children as her only surviving heirs. (1) William A. FREEMAN, a son, who died about 3 years ago. (2) Sarah A. McCLESKY. (3) Senthy Willie WATSON, wife of Bud WATSON moved about 1873 or don't know whether she is now living or dead, but know that she was living in 1880. (4) Texanna RHODES, wife of Leah RHODES, moved about 1877 or 78, do not know of my knowledge where she died, am informed that she died in Lampasas Co. in 1913. (5) Kate MORGAN, wife of Fred MORGAN, now living in Bastrop Co., Tex. That tract of land of 100 acres, part of A. MAYS Survey in Bastrop Co., Texas, which was sold by MCCLESKY & wife to D. C. HENDRIX by deed of date Nov. 10, 1876, recorded in Book K, p. 192 & 193, Deed Records Bastrop County - There were in cultivation of said tract about 60 acres when D. C. HENDRIX bought the tract and that D. C. HENDRIX enclosed whole 191 acre tract except about 18 acres with fence on or about 1878 or 1880. That said D. C. HENDRIX and those claiming under him held continuous possession occupying same up to the time D. C. HENDRIX sold off the 50 acre tract to John D. HENDRIX March 10, 1897 and that John D. HENDRIX went into immediate possession of said 50 acres when he bought it and occupied same continuously from that date up to the time he sold to Bud GOOTMAN of date Oct. 29, 1908 & GOOTMAN went into possession of same at time he bought it & has occupied, used & cultivated same continuously up to the present time. Affiant further states that William Thomas HENDRIX and those claiming under him held actual possession of the whole of said 191 acre tract from Aug. 25, 1892, the time he bought same from D. C. HENDRIX, up to the time he sold off the 50 acre tract back to D. C. Cannon H. in and for answer to the amended petition of the plaintiff filed at the January term of the Probate Court AD 1853. Says that all the statements and allegations contained in her said amended petition are untrue. He states that the said plaintiff has never aided or assisted his father, William Cannon Decd, in acquiring any property now owned by his estate. He charges that the said Agnes K Cannon refused to come to Texas with the said William Cannon from the State of Alabama that many years after his arrival in Texas, having come to the country poor and penneless tho said plaintiff to wit in the year 1839. Came in a hasty visit from a Foreign Government and wanted the said William to give her a portion of the property he had above and unaided by the said plaintiff acquired in the wilds of Texas. At which time this defendant's father the said William, proposed to receive her as his wife and to share his property and toils with her, which she declined doing but went back to a thru foreign government to wort the state of Alabama of the United States of America. She has at all times refused to live with the said William Cannon Decd, has never aided or assisted in acquiring any of the estate of the said William but declined doing so and utterly refused to live with the said William and to share his toils in this government of property or to aid him with and comfort the said William as her husband. and this defendant further states that he is satisfied from information of a reliable character that it is the machanations and management of designing now who are figuring to deprive him of his patrimony as the sole heir, to said estate the said Agnes K never did ungo any claim either for an interest in community or for alimony during the life of the said William but abandoned him to his fair as aforesaid to do the best he could solitory and alone, wholly unaided or comforted by her as a wife. And he further charges as he has in his answer to the original petition denying all allegations and regains proof of all matirial allegations and having fully answered prays to be discharged with his costs. That said petitioner did not assist the said Wm Cannon in his acquisition of any of the property she now claims. That she never performed the office of wife in any capacity whatever on the contrary absolutly refused to ? said offering but remarried an alien to this republic of Texas and an alien to the domicil of his deceased father. That if petitioner was ever married to his said father Wm Cannon and she absolutly withdrew herself from his roof previous to said deceased emigrating to Texas. ? renounsing all right to any partipation in the bienes ganancials or community property in said estate defendant further says that he is the only heir of the said Wm Cannon and is then for entitled to the whole said estate both real and personal. And defendant further answer says that the said Agnes K Cannon alias Patterson was never the wife of his said deceased father Wm Cannon. That the said Cannon took a wife whom maiden name was MARY MORGAN the mother of the defendant that the said Mary died in the year 1831 or 2 previous to the emmigration of his deceased father to Texas and that the said Wm Cannon never married after his arrival in Texas. Cannon H. in and for answer to the amended petition of the plaintiff filed at the January term of the Probate Court AD 1853. Says that all the statements and allegations contained in her said amended petition are untrue. He states that the said plaintiff has never aided or assisted his father, William Cannon Decd, in acquiring any property now owned by his estaet. He charges that the said Agnes K Cannon refused to come to Texas with the said William Cannon from the State of Alabama that many years after his arrival in Texas, having come to the country poor and penneless tho said plaintiff to wit in the year 1839. Came in a hasty visit from a Foreign Government and wanted the said William to give her a portion of the property he had above and unaided by the said plaintiff acquired in the wilds of Texas. At which time this defendant's father the said William, proposed to receive her as his wife and to share his property and toils with her, which she declined doing but went back to a thru foreign government to wort the state of Alabama of the United States of America. And defendant further answer says that the said Agnes K Cannon alias Patterson was never the wife of his said deceased father Wm Cannon. That the said Cannon took a wife whom maiden name was MARY MORGAN the mother of the defendant that the said Mary died in the year 1831 or 2 previous to the emmigration of his deceased father to Texas and that the said Wm Cannon never married after his arrival in Texas. They are the family next to Sarah Wells and the boys so I would conclude that Margaret was married to John Walters mentioned above and when he died she married the Blair person, making 8 known children of Martin Wells. There is also the child that was the first person buried at the Fairview Cemetery so that would be 9. These papers list 8 beneficiaries: 1. Mary Wells who married John Landrum Norman Woods (see below) 2. Wyman F Wells 3. John Morgan Wells John Walters (see below) 4. Daniel A (David A) Wells 5. Martin J Wells 6. Henry B. Speir, a resident of the municipality of Mina, whom I know, and to where acts-I give full faith and says that on the 4th day of the present month, Martin Wells, a resident of the municipality aforesaid, being suddenly attack with a disease unknown to him the said Speir and he the said Wells being about to depart this life, made the following will; to which he the said Speir declares he was called by the said Wells to bear witness which will is as follows: Vis: First- that the league of land granted to said Wells by the Mexican Government, and on which he then had, should stand divided in eight equal parts according to a pate survey of the municipal surveyor. Thomas Mays That-John B. Walters should have the next of second eighth on the Colorado. That-John M. Wells should have the next of second eighth running un said River Colorado. That-Waymon F. Wells should have the next third eighth running up said river and That-Norman Woods should have the next fourth or upper eighth on said river Colorado. that the said Speir further states that he was informed by the afore and Martin Wells informed him that there was also four eights of the league aforesaid from Wilbarger's Creek of which he wished his Son, Martin Jones Wells, to have first choice, the three remaining eights-of said league to pass his sons, David A. Wells and Henry B. Wells and his daughter Mary Landrum, that he wished the whole of said land divided by Thomas Mays and that the person drawing the river land should pay to those remaining, the creek-land, the difference that said Mays might say existed. He the said, Martin Wells, further wished all his personal property sold on twelve months credit, except the household, and that the proceeds there of should go towards schooling and raising the minor heirs, to be used by the Executors as they may think proper for the purposes aforesaid. His disability was old age, his religious persuasion, none. Listed as those to notify in case of death are J. B. WATSON, a brother, of Cedar Creek, Bastrop Co., and J. M. WALKER, a "son," of Cleburne, Texas. TX CSA pension #14631, Bastrop Co. TX 14 Aug 1909, Thomas D. Watson, age 73, born Gibson Co., Tennessee; resided in Texas 60 years, P.O. Red Rock (R.F.D. #1). Barnard, died on the 19th day of Nov., 1940, in the town of Austin County of Travis, Texas. The pensioner died in the home of Sons & Daughters , who was related to the pensioner as Mrs. Mary E. Barnard's children. That the warrant, which application is hereby made for, shall be applied to paying all or part of the funeral expenses incurred by the said pensioner Mrs. Mary E. Barnard.
