Murder Charge is Filed Against Dairy Operator

N. B. Hall, 28, operator of a dairy at 3533 Clark Street, faced a charge of murder Wednesday following the death of Hubert Pechacek, 19, in St. Josephs Infirmary Tuesday night.

Pechacek, an employe at the dairy, was wounded three times in the chest and abdomen Monday morning while he was milking a cow in the shed of the dairy.

Hall, who surrendered to Patrolman S. H. Clauder, made a signed statement to police in which he said that he shot Pechacek because of attentions he had been paying to Mrs. Hall. He had been at liberty under $500 bond on a charge of assault to murder, until Pechacek's death.

When the charge was changed to murder, bond was raised to $1000. Hall made bond as he surrendered on the new charge. He will be given an examining trial January 11.

Pechacek's body will be sent to Cleveland Thursday by the Perry Funeral Home.

He is survived by his wife, Mrs. Alice Pechacek; a son, Herbert Pechacek; his parents, Mr. and Mrs. J. L. Pechacek; two brothers, Joe and Melvin Pechacek, and a sister, Miss Jessie Pechacek.

Bullet wounds received early Monday morning proved fatal Tuesday night to Hubert Pechacek, 19, dairy worker, who was shot in a milk shed on Clark street road.

Pechacek was shot three times in the abdomen and chest. He was removed to St. Joseph's Infirmary where he died at 9:30 p. m. Tuesday after undergoing a blood transfusion early in the afternoon.

After the Monday morning's shooting, N. B. Hall, 28, operator of a dairy on Clark street road, surrendered to Patrolman S. H. Clauder, a neighbor. In a statement to Captain Dave Turner of the police homicide squad Hall said he shot Pechacek because of attentions he had been paying Mrs. Hall.

Mrs. Hall also made a statement to Captain Turner.

A charge of assault to murder was filed against Hall before Justice of the Peace Campbell R. Overstreet.

Pechacek is survived by his wife Mrs. Alice Pechacek; a son, Herbert Pechacek; parents, Mr. and Mrs. J. L. Pechacek; two brothers Joe and Melvin Pechacek and a sister, Miss Jessie Pechacek.

The body will be sent to Cleveland Thursday by the Perry Funeral home for burial.

Youth Shot at Dairy In Critical Condition

Hubert Pechacek, 19-year-old dairy employe wounded three times at a dairy in the 3500 block on Clark Street Road early Monday, remained in a critical condition at St. Joseph's Infirmary Tuesday.

N. B. Hall, 28, operator of the dairy, was at liberty under $500 bond, fixed by Justice Campbell Overstreet, before whom a charge of assault to murder is pending against Hall in connection with the shooting.

Hall, in a statement to police, admitted that he shot Pechacek and said it was because of attention the latter had been paying to his wife.

Dairy Worker Is Wounded

N. B. Hall Makes Bond After Hubert Pechacek Is Shot.
Hubert Pechacek, 19-year-old dairy worker, was in a critical condition at St. Joseph's infirmary Monday night with three pistol shot wounds in his body.

N. B. Hall, 28, operator of a dairy on the Clark street road, surrendered to the police and was at liberty under $500 bond on a charge of assault to murder Pechacek.

Hall, in a statement to Captain Dave Turner of the police homicide squad, said he shot Pechacek because of attentions the latter had been paying to his wife.

Mrs. Hall also made a statement to the police.

The shooting occurred about 4 a. m. Monday in the dairy barn while Pechacek was milking a cow. Hall then went to the home of Patrolman S. H. Clauder, who resides a short distance from the dairy, and surrendered.

Deputy Sheriffs Dinkins and Trapolino and Investigators B. W. Payne and George Andrew of the district attorney's office aided the police in the investigation.

A Houston Funeral home ambulance carried Pechacek to the hospital where attendants said his chances to recover were slight.

Two bullets entered Pechacek's left breast and a third struck him in the abdomen.

Hall Posts Bond In Dairy Slaying
N. B. Hall, 28, Clark street dairy operator, appeared before Justice of the Peace Campbell R. Overstreet Wednesday and was released under $1000 bond on a charge of murder of Hubert Pechacek, 19.

Pechacek, an employe at the dairy, died Tuesday night in St. Joseph's infirmary from three bullet wounds in the body.

In a statement to police Hall said he shot Pechacek because of attentions paid by the latter to Hall's wife.

The shooting occurred at 3 a. m. Monday at the dairy. Hall had been at liberty under bond on an assault to murder charge.

Accompanied by his attorney, Arthur Heidingsfelder, Hall appeared at the court house Wednesday morning and was released under $1000 bond pending examining trial on January 11.

Dairyman Released Under $2000 Bond In Slaying of Employe
N. B. Hall, 28, operator of a dairy on the Clark Street Road, was released under $2000 bond following a preliminary hearing Wednesday afternoon on a charge of murder.

Hall was charged with the fatal shooting January 2 of Hubert Pechacek, an employe of the dairy. Pechacek died in a hospital two days after the shooting.

A statement made by Hall shortly after he surrendered to police was offered in evidence at the hearing by City Detective A. P. Martial.

Improper relations between Mrs. Hall and Pechacek, as claimed by the defendant as the cause of the shooting, was corroborated by the defendant's wife on the witness stand.

Defense Attorneys A. E. and C. E. Heidlingsfelder offered the testimony of Mrs. Hall after Prosecutor Tom J. Harris, assigned to the prosecution of homicide cases, introduced the defendant's statement.

Assistant District Attorney Harris urged Justice Overstreet to fix a large bond for Hall after the hearing. Hall had been at liberty under $1000 bond since the shooting.

Justice Overstreet set bond at $2000 and Hall was released a few minutes later after his attorneys produced the bail.

Hall Held to Jury In Dairy Slaying
N. B. Hall, 28-year-old Clark street road dairy operator, was held to the grand jury under $2000 bond after a preliminary hearing Wednesday before Justice of the Peace Campbell R. Overstreet on a charge of murder of Hubert Pechacek.

Pechacek was wounded on the morning of January 2, and died two days later.

Hall surrendered to police and made a statement in which he said he shot Pechacek, an employe at the dairy, because of attentions the latter was paying to Hall's wife.

The statement made by Hall was introduced in evidence through Detective A. P. Martial of the homicide squad.

Hall had been at liberty under $1000 bond, but the bail was raised by Justice Overstreet to $2000 at request of Assistant District Attorney T. J. Harris, prsecutor, assigned to homicide cases.

Hall made bond and was released immediately after the close of the hearing.

Operator of Dairy Indicted in Slaying
N. B. Hall, operator of a dairy on the Clark Street Road, was indicted Monday for the fatal shooting of Hubert Pechacek, an employe, on January 7.

Hall admitted the shooting and said that Pechacek had been paying attentions to Mrs. Hall.

The dairy operator has been at liberty on bond since he was charged with the shooting.

Hall Indicted in Dairy Slaying
N. B. Hall, operator of a dairy on Clark street road, was indicted Monday by the Harris county grand jury on a charge of murder of Hubert Pechacek, 19.

Pechacek was wounded fatally at the dairy on January 2.

According to testimony at the examining trial, Hall shot Pechacek over attentions paid by the latter to the dairy operator's wife.
