Be it remembered that on the 31st day of August A.D. 1840 - The Honorable Probate Court for the County of Refugio met in pursuance to law - Present the Hon. Benj. F. Neal Judge of said Court.  Barttell Annibal Sheriff and John Clark deputy Clerk.

Legal notice having been given of the application of Michael Fox praying the appointment of adminisr. upon the estate of John Kelly deceased, it is ordered and decreed by the Court that the said Petitioner be appointed administrator thereon, the Petitioner giving bond in the sum of five hundred dollars - Whereupon the said Fox being called gave bond and took the oath required by law.

It is further ordered by the court that James Collinsworth, Patrick OLeary [O'Leary] and Henry Ryals be appointed appraisers of said estate.

Melinda Baker having presented in open court the inventory and appraisement of the estate of John Baker deceased certified according to law together with a petition praying an order of sale of all the Perishable property of said estate to discharge the remaining debts of the estate - It is ordered and decreed by the Court that the inventory of appraisement be filed with the other papers of the succession and that the prayer of the petitioner be granted.

In this cause the parties came into Court by their attornies and prayed the Court to grant a continuance -

Whereupon the said case is continued by consent of both parties until the next term.


There being no book suitable for the recording of wills in possession of the Probate Clerk - It is ordered and decreed by the Court that all wills hereafter probated shall be recorded in the Probate Court record until otherwise provided for.

It is ordered that the court adjourn until Court in course.
