Be it remembered that on the 11th day of Sept. A.D. 184__   In the Probate Court in vacation sitting filed his Petition praying the appointment of administrator upon the estate of Duncan Drummond deceased.  Whereupon it is ordered by the Judge of Probate that public notice be given according to law.

Be it remembered that on the 28th day of September A.D. 1840, The Honorable Probate Court for the County of Refugio met pursuant to adjournment.

Present Benjamin F. Neal Judge of Probate, James B. Collinsworth deputy sheriff and John Clark deputy sheriff.

The Clerk wishing to absent himself for the day whereupon the Court appointed William McDaniel was appointed Clerk pro tem.

vs.
Heirs of Elizabeth OBrian [O'Brien]

Petition for Partition of Estate.

The defendants in this case having been legally noticed and no one appearing to make objections or show cause why the said writ of partition shall not issue -  It is ordered & decreed by the court that the Clerk of the Probate Court issue a writ of Partition directed to James B. Collinsworth, Henry Ryals & Michael Fox commissioners or a majority of them to make a fair and equal division of said estate according to law.

J.C. Pierce.

In this cause the attorney for plaintiff being absent the case is continued until court in course.


Thomas OBrian [O'Brien] heir and legal representative to Elizabeth OBrian [O'Brien] decd, being a minor, It is ordered by the Court that John W. Bower be appointed Guardian ad litem and Letters of Guardianship issue thereon to the said John W. Bower he giving bond to the amt of five hundred dollars.

It is further ordered by the court that Henry Ryals, James Power and John R. Talley be appointed appraisers of the aforesaid property belonging to the said O'Brian
[O'Brien].


Joshua W. Littig Petition
for letters of administration
on the estate of D. Drummond

In this cause the Petitioner Joshua W. Littig came into Court and objections being made to the granting the prayer of the Petitioner by George R. Hull -  The Court after hearing the Testimony of both parties ordered and decreed that the Clerk of the Probate Court issue letters of administration to Joshua W. Littig, he giving bond in the sum of Ten thousand dollars -  It is further ordered by the Court that Henry L. Kinney, J.W. McFarland and Willard Richardson be appointed appraisers upon said estate -

Petition for order of sale.

In this cause there being on (sic) objection filed - It is ordered by the Court that the Petitioners prayer be granted with such power as the law direct.


It is ordered by the Court that Peter Teal Administrator upon the estate of George McKnight be cited to appear at the next term of the Probate Court and make settlement of said succession.


It is ordered by the court that John W. Bower administrator of the estate of Elizabeth OBrian [O'Brien] be cited to appear at the next term of the Probate Court and make settlement of said estate.


It is ordered by the Court that J. Fagan administrator of the estate of John Williams deceased be cited to appear at the next term of the Probate Court and make settlement of the said succession.


It is ordered by the Court that John W. Bower administrator of the estate of Andrew OBrian [O'Brien] decd. be cited to appear at the next term of the Probate Court and make settlement with the Court of his said administration.


It is ordered by the Court that Patrick Lawler admr on the estate of Martin Lawler be cited to appear at the next term of the Probate Court and show cause why he has not made return of his said administration according to law.


It is ordered by the Court that James Power be cited to appear at the next term of the Probate Court and make settlement of his said administration on the estate of Daniel Keane decd.


It is ordered that the court adjourn until court in course.
