Probate Records and Wills

When a will is presented for probate, an executor (usually named in the will) is appointed by the Court.  If no Will is presented, a person can apply to be appointed administrator of the estate.  Probate records include both probate of wills and administrations of estates with no wills.

Early Probate Minutes are included here because of the numerous names involved.  This type of record helps to place a person in an area between census dates, as well as to narrow down dates of death.

The following is the first entry in the Probate Records:

Republic of Texas,  }
County of Refugio.  }

Be it remembered that on the last Monday of May the 25th A.D. 1840 -- The Honorable Probate Court for the County of Refugio met at the Court House at the Town of the Mission of Refugio and was organized according to law.  Present the Hon. Benjamin F. Neal Judge of the Probate Court, James Byrne Clerk and Jeremiah Findley Sheriff.

"There being no Book of record of proceedings in the Probate Courts heretofore holden in the County of Refugio, but that each case having been kept upon separate pieces of paper --- It is therefore ordered by this court that the names of the several cases be entered on record according to the date when they were acted upon by the Probate Court."

On October 12, 1840, it was ordered by the Court that the Sheriff take possession of the Public Property known as the Stone Church and procure benches, tables and locks for it as necessary.  This, it is assumed, was the first Courthouse for Refugio County.
