These presents witness that I James Morris being weak in body but of sound mind, memory and understanding do make this my last will and testament, that is to say

I do will and bequeath to my friend and partner in trade, Thomas Thatcher all and singular my real and personal estate situate being and existing in Texas - To have the same for his own use, and I do hereby appoint him sole executor of this my said last will and Testament.

I (sic) witness whereof I have hereunto subscribed my hand and set my seal as New Labahia the eighth day of June A.D. 1840.

Be it remembered that on the 27th day of July A.D. 1840 In open court personally came and appeared William Davis who after being duly sworn deposeth and says:  that the foregoing will was signed by James Morris deceased in his presence and that he is a subscribing witness to the same and that he verily believes that the said Morris had made no other will of subsequent date, than the one now exhibited in court, and further deponent sayeth not -
