Jacob and Ruth Early to Daniel Duckwiler, 292 acres in Botetourt County
This Indenture made this 16th day of November 1826 between
Jacob Early and Ruth his wife of Franklin County and State of Virgin-
ia of the one part and Daniel Duckwilder of Botetourt County
and State aforesaid of the other part Witnesseth that the Said
Jacob Early and Ruth his wife for and in consideration of the
Sum of one hundred and fifty Dollars to them in hand paid
the receipt whereof is hereby acknowledged hath granted bargained &
Sold and by these presents doth grant bargain and Sell unto the
Said Daniel Duckwilder his heirs and assigns one certain Tract or
parcel of Land in Botetourt County on the waters of Back Creek which
is a branch of Roan River containing 292 acres (be the same more
or less) and Bounded as followeth to wit Beginning at two white
oaks corner to Mathias ……. thence with lines of the Same N84
E56 poles to a Dogwood and White Oak on a line of Sniders Land
thence with lines of the Same S38 ½ W68 poles crossing a branch to
a black oak & Spanish Oak S11 W152 poles to a white oak & ches-
nut N70 E60 poles to a gum and chesnut L65 E64 poles to a
Locust N75 E60 poles to a white oak and red oak S20 W3 poles
to two Dogwoods and Chesnut corner to his own Land thence
with lines thereof leaving Sniders land S75 ½ W150 poles to two
chestnuts and a Hickory Stump S1½ E77 poles crossing the great
road to a black oak S55 E98 poles to a chestnut on the side of
the Mountain N52 E90 poles to two poplars and a lynn N16
W32 poles to two chestnuts N38 E56 poles to three Hickories S61
E50 poles to Harveys line thence with it S20 W170 poles to a
chestnut and two chestnut oaks near the Top of the Mountain
N66 W230 poles to two chestnuts and chestnut oaks N74 W62 poles to the
North End of a large rock N71 W68 poles passing a chestnut a
chesnut corner to Kinzie at 22 poles to two Spanish Oaks N50 ½
W 54 poles to a white oak near the great road corner to Kinzie
thence with his lines N11 E28 poles crossing the road to a Spanish Oak
N2 W42 poles to a white oak & hickory N74 ½ W182 poles to a white
Oak Red Oak and Maple on the points of a ridge near a branch
N7 E65 pole to a chestnut and Spanish Oak on McElhaneys line
and thence with the Same N55 E218 poles to the Beginning.
Together with and singular the appurtenances thereunto belonging
or in any wise appertaining To have and to hold the said bar-
gained Land and premises unto him the said Daniel Duckwilder
his heirs and assigns forever free from the claim of them the
said Jacob Early and Ruth his wife their heirs and assigns
and from all persons claiming under them. In witness whereof
the said Jacob Early and Ruth his wife have hereunto Set their hands
and Seals the day and year first above written.

We Patrick Hise and Moses Greer, Jr. Justices of the Peace in the county
aforesaid in the State of Virginia do hereby certify that Jacob Early
party to a certain Deed bearing Date on the 16th day of November
1826 and hereto annexed personally appeared before us in our
County aforesaid and acknowledged the same to be his act and Deed
and desired us to certify the Said acknowledgement to the Clerk
of the County Court of Botetourt in order that the said Deed May
be recorded given under our hands and Seals this 16th day
of November 1826

We Patrick Hise and Moses Greer Jun. Justices of the Peace in the County
aforesaid in the State of Virginia do certify that Ruth Early the
wife of Jacob Early parties to a certain Deed bearing date on the 16th
day of November 1826 and hereunto annexed personally appeared before
us in our County aforesaid and being examined by us privily and
apart from her husband and having the Deed aforesaid fully Explain-
ned to her the Said Ruth Early acknowledged the Same to be her
act and Deed and declared that she had willingly signed sealed
and delivered the Same and that she wishes not to retract it.
