SYBERT JN to BURGER
This Indenture made the 12th day of July one Thousand seven hundred and ninety
Six Between John SYBERT and Ann Eliza his wife of the County of
Botetourt & State of Virginia of the one part and Hanry (Harry?) BURGER
of said County of the other part Witnesseth that the said John SYBERT
and A Eliza his wife for and in consideration of the Sum of one hundred pounds
current money of Virginia to them in hand paid doth bargain and Sell unto the
said Hanry BURGER and his heirs one certain Tract or Parcel of Land in
the said County of Botetourt containing one hundred acres lying on the South
side of Catawba Creek joining the Land of Robert CALDWELL and Thomas THOMPSON
and is bounded as follows; to wit, Beginning at a black oak and white oak
corner of THOMPSON’s Land and with a line of the Same south Eighty Seven
degrees west one hundred and eighty poles to a white oak corner of CALDWELL’s
Land South Sixty degrees east one hundred and thirty poles to two white oaks by
a Gully thence North thirty degrees east eighty poles crossing a branch to two
white oaks North forty eight degrees East Sixty eight poles to three white oak
Saplings south fifty six degrees East Sixty six poles to three hecories growing
out of one root thence south forty four degrees west one hundred and Sixteen
poles to the Beginning together with all its appurtenances To have and to hold
the said Tract or Parcel of Land with its appurtenances to the said Hanry
BURGER and his heirs to the sole use and behoof of him the said Hanry
BURGER and his heirs forever and the said John SYBERT and A Eliza his wife for
themselves and their heirs doth covenant with the said Hanry BURGER and
his heirs that the said John SYBERT and a Eliza his wife and their heirs
the said Land with all its appurtenances unto the said Hanry BURGER and his
heirs against all persons whatever will forever warrant and defend In Witness
whereof the said John SYBERT and A Eliza his wife have hereunto Subscribed
their names and affixed their Seals the day + year above written

This Indenture of bargain and Sale was acknowledged in court by John SYBERT
