William M Bishop to Thomas E. Martin

 

Whereas about the year 1869 William M. Bishop
sold to one Thomas E. Martin a certain tract or parcel
of land situate, lying and being in the County of Craig
on Johns Creek & in the State of Virginia, supposed
to contain Two hundred acres for the sum of
Five thousand dollars, receiving a hand or down
payment of about $850.00 and the bonds of the said
T. E. Martin for the residue and deferred payments
but no deed of Conveyance was executed.
  And whereas the said T. E. Martin has sube-
quently made sale of the said tract of land to one
John M. Caldwell and he the said J. M. Caldwell
desiring Conveyance from all the parties
  Now therefore this deed made this 22 day 
of December 1875 Between William M. Bishop
and Naomi, his wife, L. A. Brown
and Mary E. Bishop of the County of Bland
and Thomas E. Martin and Elizabeth A.,
his wife of the County of Craig all of the state of
Virginia of the one part and John M. Caldwell
of the County of Craig and State aforesaid of the
other part  Witnesseth:  That for and in consider-
ation of the premises, and for the further considera-
tion of the payment of the entire purchase money
the receipt whereof is hereby acknowledged, That
they the said parties of the first part do grant,
Bargain and Sell unto the said John M. Caldwell
his heirs and assigns with General Warranty, all
that certain tract or parcel of land lying and
being in the County of Craig on Johns Creek adjo-
ining the lands of Joseph Looney, and the lands
purchased of said Bishop by James S. McClanahan
and is bounded as follows to Wit:  Beginning
at 2 White Oaks corner to Joseph Looneys land
and with the lines of thte same N 43 E 36 ps. to
3 white oaks (2 cut down) N 30 W 68 ps. to 2 pines (one down)
N 54 W 66 ps. to 2 pines & a red oak (one pine down) by
a branch N 31 W 88/87 ps. to 2 White Oaks & a poplar,
and leaving said Looneys land S 56-1/2 W 35/34 ps.
crossing a branch at 7 ps. to 2 white oaks and a
hickory on the N. side of a small ridge S 31-1/4 E
84/83 ps. to 2 pines (dead) S 73 W 30 ps. to a stake 1 pole
and 90 links N 73 E from a pine marked.  Division
comes between said T. E. Martin & James S. McClanahan
thence with Division line S 7 W 132/129 ps. to a poplar
on the S. W. side of Johns Creek N 88 E 6-1/2 ps. crossing
creek to a locus stake S 7-1/2 E 24 ps. to a single
& a double white oaks S 32-1/2 E 73-3/4 ps. to a white
oak, 2 black oaks and 2 red oak saplings thence
leaving division line and with said Looneys line
N 72-1/2 E 185 ps. crossing creek 3 times to a white oak
and black oak dead on the North side of
of [sic] Creek N 62 W 134 poles to a hickory, thence
N 56 E 30 ps. to the Beginning containing One
hundred and Ninety acres more or less
with all and singular the appurtenances thereunto
belonging or in any wise appertaining, to have and
to hold, to the only proper use and behoof of him
the said John M. Caldwell his heirs & assigns forever
