This Indenture made the eighth day of September in the year of
our Lord one thousand eight hundred and thirty two between Phillip
Kist and Ann his wife of the County of Loudoun and Commonwealth
of Virginia of the one part and John Wenner of the County of Loudoun
and Commonwealth of aforesaid of the other part ??? that said
Phillip Kist and Ann his wife for and in consideration of the
sum of one hundred sixty five dollars lawful money of the United
States to them in hand paid by the said John Wenner at and before
the sealing and delivery hereof receipt whereof they do here by
acknowledge and thereof ??? ??? them of do forever execute acquit
and discharge the said John Wenner his heirs executors and administrators
by there presents have granted bargained and sold aliened ???
released and confirmed and by these presents do grant, bargain,
sell, alien ???, release and confirm unto the said John Wenner
his heirs and assigns forever a certain lot or parcel of land
situated in the County of Loudoun in the State of Virginia and
???ded as follows:
Beginning at A a stone in a line of Catharine Mull thence S 33
1/2 E 6 Poles 10 lks to B a stone in a line of lot No 3 thence
with the same N 60 1/3 E 55 Poles to C a stone in said line about
3 feet south of a white oak thence N 33 1/2 115 1/4 poles to D
a stone in a flat about 3 feet south of a black oak in Catharine
Mulls line thence with the same S61 1/3 1155 poles to the Beginning
containing two acres as by deed from John Booth to Phillip Kist
bearing date on the 24th day of February 1826 and recorded in
the Clerks Office of Loudoun County Virginia in Leber LLL folio
398. Together also with all and regular the right, member, liberties,
priviledges, improvements, herditaments and appurtanances whatever
there unto belonging or in anywise appertaining and the reversions
and remainders, rents issues and profits thereof, also all the
estate right title, interest, uses, ???, property claims and demand.
Whatsoever of them the said Phillip Kist and Ann his wife in law,
equity or otherwise however into or out of all ??? the premises
and every part thereof To have and to hold all and singular the
premises herby granted with the appurtinances unto the said John
Wenner his heirs and assigns to the only proper use, benefit and
??? of the said John Wenner his heirs and assigns forever and
the said Phillip Kist and Ann his wife for themselves, their heirs,
executors and administrators do hereby covenant and agree to warrant
and defend all and singular the premises herby granted and conveyed
unto the said John Wenner his heirs and assigns forever free from
the claims of them and of every other person and free from all
other bills and incumberances whatsoever. In witness whereof the
said Phillip Kist and Ann Kist have hereunto set their hands and
seals the day and year first above written.
