This Indenture made this 14th day of February eighteen hundred
and eleven Between Joseph Braden of the County of Loudoun and
State of Virginia of the one part and Stacy Taylor and Stephen
C. Roszell [?] of the County of Loudoun and State aforesaid of
the other part
Witnesseth that the said Joseph Braden for and in consideration
of the Sum of Seven Thousand one hundred and seventy Dollars Lawfull
[sic] money to him in hand paid by the said Stacy Taylor and Stephen
C. Rozell, the rect whereof He doth hereby acknowledge hath Granted
Bargained and Sold and by these presents doth Grant bargain and
Sell unto the said
[page 200] said [sic] Stacy Taylor and Stephen C. Rozell, their
heirs and assigns all that Tract or parcel of land Which the said
Jos. Braden purch'd of John Cummings Situate lying and being in
the said County of Loudoun and Bounded as follows -
Beginning at a red oak on the side of the main road corner
to Wm. Smith thence with his Line N 34 W 66 1/3 p'l [?] to stone
corner to Braden a John Nicklen [?] thence with Nicklins line
N 54 E 42 p to a stone corner to Nicklin thence with another of
his lines N. 89 + E 104 3/4 pl. to a stone and White oak in a
line of Rich. Wittith [?] thence with said line S. 3 E. 243 +
po. To a Stone on the south side of the main road thence down
said Road S. 43 + E. 51 1/3 po. To a Stone thence S. 32 1/4 W.
31 + po. To a Stone Corner to Mathew Beans thence N 67 W. 204
+ po. To a stone in William Smiths line thence with said line
N. 31 3/4 E. 45 1/3 po. To a B. Oak Corner to Smith thence with
his line N 9 1/4 E 98 + po. To the Beginning Containing two hundred
and thirty nine acres of land - Together with all and Singular
the appurtenances the right privileges and improvements whatsoever
thereunto belonging or in any wise appertaining To have And to
hold the said land and premises hereby Granted and conveyed unto
the said Stacy Taylor and Stephen C. Rozell forever In Trust Never
the less and on the following conditions. Whereas the said Joseph
Braden did on the [blank] day of [blank] 1811 purchase of John
Cummings the above described tract of land for Seven thousand
one hundred and Seventy Dollars and Whereas Robert Braden and
John Braden did enter Security and Join in the Bond with the said
Joseph Braden for the payment of the above mentioned sum to the
said John Cummings Viz. Two Thousand dollars to be paid on the
first day of April next and the remaining five thousand one hundred
and Seventy dollars to be
[page 201] to be [sic] paid to the said John Cumming in Five
equal annual payments in the first day of April in every year
until the whole is paid off. Now if the said Joseph Braden, his
heirs, Exr's or adm'r shall and doth well and truly pay to the
said John Cummings his heirs or assigns the before mentioned sum
of Seven thousand one hundred and Seventy dollars as the different
payment as they become due and entirely release the said Robert
and John Braden from the payment of any part thereof. That in
that case this deed of trust shall be Void, but if the said Joseph
Braden, his heirs, Ex'rs or adm'rs should fail in the payment
of any of the said Bonds, that then the said Stacy Taylor and
Stephen C Rozell or the Survivor of them shall for the Benefit
of the said Robert and John Braden sell the above Described Tract
of Land to the highest Bidder for cash first Giving one months
notice of the time and place of sale in one of the news papers
published in Leesburgh [sic] and after having paid all the Monies
Embraced by this deed of trust for Which the said Robert and John
Braden are bound and the Expenses [unreadable word] to this deed
and the sale thereof the said Stacy Taylor and Stephen C. Rozell
Shall pay to the said Joseph Braden, his heirs or adm'r the residue
of the Money if any. Witness my hand and seal, the day and year
first above Written.
