GATE CITY JUDGE MAY RULE TODAY ON TRIAL MOTION

Expect to Take Up Second Trial of John Barnett in

the Scott County Circuit Court Tomorrow

GATE CITY, Va., Feb. 1. ó Having disposed of the Riner murder case, which went to the jury at noon, Judge E. P. Carter is expected to rule upon motions for new trials in three murder cases upon the reconvenement of Scott County circuit court this afternoon. This will leave the court clear to begin the second trial of John Barnett for murder tomorrow, this time for the fatal shooting of Will Frazier. Barnett was convicted last week of the murder of Creed Frazier, father of Will, and sentence of life imprisonment recommended by the jury.

Motion to set aside the verdict in that case and grant Barnett, a new trial, has been made by defense attorneys and will be ruled upon by the judge this afternoon. Other motions before the court are those made to set aside the verdicts in the cases of Alfred (Red) Hamilton and S. L. Osborne, bothfound guilty of voluntary manslaughter at this term. Sentence of seven years
was recommended for Hamilton and three years for Osborne.

Second Barnett Trial May

Attract Additional Crowds

Possibility of Slayer Getting Supreme Penalty

Engenders Renewed Interest

GATE CITY, Va., Feb. 1 --- John Barnett, once convicted at this term of court for the fatal shooting of Creed Frazier, ex-sheriff of Scott County last September 20, for which a sentence of life imprisonment was recommended by the jury, goes on trial tomorrow morning on another charge of murder, that of Will Frazier who was shot down by Barnett at the same time as Creed Frazier.

The possibility that Barnett may receive the supreme penalty if he is convicted on the second charge, is expected to engender more interest in I the coming trial than was even displayed in the first. The fact that he already

stands convicted of the murder of Creed Frazier and that the second trial is rather a post-climax has not lessened the intense interest of Scott County citizens in his ultimate fate.

Expect Big Crowds

The crowds which filled the benches, lined the walls and overflowed from the century-old courtroom is expected to again materialize again for the second trial of Barnett. There is even a possibility of the crowd attending the second trial to eclipse that of the first.

Barnettís attorney at the first trial presented self defense as the motive for the killing of Creed Frazier. It is not know yet whether the same defense will be presented for the murder of Will Frazier, an entirely new angle will be taken by the defense.

The two Fraziers wore shot at a sawmill near Speer's, Ferry as they approached. Will being killed instantly and Creed dying later in a Bristol hospital. Eye witnesses of the double shooting said that Barnett had threatened Will Frazierís life earlier in the day and had opened fire on the Fraziers with a high power rifle as they approached the mill. Roy and Mahone Frazier, kinsmen of the slain men, said that the party was returning to the mill to effect an amicable settlement of a quarrel with Barnett.
