Last Will and Testament of Joseph Wiglesworth

I Joseph Wiglesworth of Spotsylvania County being weak & low but of 
Sound mind & memory do constitute this my last Will & Testament 
revoki[ng] all others heretofore made by me in the man[ner] following 
Viz

[Item 1}st.  I wish all my Just debts & funeral expenses [missing] first 
paid out of the sale of my crops [& peri}shable estate.

[Item]  I lend to my beloved Wife Ann Wigles[wor]th the following 
property to wit the whole of my tract of Land South of the road Leading 
to Wallers Tavern together with the following negroes Walker Lindsay 
Nelley & her child betsy, patsy Jim Sylvia Cyrus Cealy George & Eady & 
all the Increase of the females, during her life or Widowhood & after 
her death I give the same to my son Warren A. Wiglesworth but in case 
she should marry again she is to have only one third of the Land with 
the houses & half the Negroes named & my son Warren A the Ballance [sic] 
& at the death of my [sa]id wife I wish my son to have all the property 
heretofore lent or may be hereafter named.  I also lend [o]ne half of 
the Household & all the Kitchen furniture [missing] taken at appraise 
Value one third part of the [missing] of my perishable Estate also my 
gigg [sic]& harness.

[Item] I give unto my Daughter Kitty I. Wiglesworth [the] following 
negroes to wit Fanny Mary Henry Parmelia Harry Mariah John Partrick 
[sic] & Sam which said negroes I give to her & her heirs forever also 
one fourt[h] part of my household furniture with one fourth Part of my 
Perishable estate.

4thly, I give to my son Mansfield Wiglesworth the following Negroes to 
wit Isabel, Thornton, Rose Tom Overton & Ailsey and that part of my 
la[nd] which lies north of the road leading to Wall[ers] Tavern also one 
fourt[h] part of my Perishable [missing] meaning in every case after my 
Debts are paid [missing] residue to be divided on[e] fourt[h] part of 
the house[hold] furniture.

5th.  The Ballance [sic] of my Estate not heretofore given away or 
loaned I wish to be divided between my sons William John Callum Joseph & 
Addison Wiglesworth & in the event that my son Addison being dead his 
portion to be divided between the four surviving ones or their legal 
representatives I also desire my Estate to be kept together until the 
crop now began is finished the discretion to be used by my Executor 
hereafter to be named.

Lastly I constitute & appoint my friend & relati[ve] John Wiglesworth my 
Executor to this my la[st] Will & Testament of whom I direct the court 
[missing] no security for the Execution of my Will.

Witness my hand & seal this 28th day of [missing] 1827.

At a Court held for Spotsylvania County the 5th day of March 1827.
The last will and testament of Joseph [A. Wig]lesworth deceased was 
proved by the [oa]ths of William B. Blaydes and Henry {Duer]son two of 
the witnesses thereto and [is or]dered to be recorded ~ and on the 
[moti]on of John Wiglesworth the executor [there]in named who made oath 
thereto [and] entered into and acknowledged a bond [in] the penalty of 
$16000 conditioned as the law directs Certificate is granted him for 
obtaining a probate of said will in due form.
